Job Injury Whenever an employee is absent from employment and unable to perform his/her duties as a result of injuries sustained in the course of employment, or in the event that an employee has been physically disabled because of an assault of his/her person in the course of his/her employment, the District shall grant the injured employee leave with benefits (retirement, social security, sick leave, and salary placement) for a period not to exceed one (1) year. During such a period of disability, the employee may utilize his/her sick leave account to compensate for the difference in the amount of worker’s compensation, if applicable, and his/her regular salary to the limits of his/her accrued sick leave account. Sick leave account shall be reduced in the same ratio as the payout bears to his/her total salary. Absence resulting from an injury suffered in the performance of the employee's usual duties shall be submitted to the Employee Benefit Insurance Cooperative for determination of benefits under the statutes governing workmen's compensation. The District shall pay full and usual compensation to the employee to the extent of accumulated sick leave. Any benefits paid by the Cooperative shall be remitted to the District until accumulated leave is exhausted. The employee's accumulated leave account shall be reduced by a fraction equal to the Districts payout as compared to total salary. Non-duty connected injuries shall be considered as an illness.
