ACCEPTANCE OF PACKAGES. As a convenience to tenants, Landlord will accept packages sent to Tenant via UPS, FedEx, U.S. Mail, or any other carrier. However, Landlord will not accept or sign for Certified Letters or Registered Mail. Landlord will notify Tenant that a package has arrived and is available for pick up at the Management Office. Packages will be held in the Management Office for ten (10) business days, after which unclaimed packages will be returned to the carrier or the sender. Tenant agrees that Landlord will not be responsible for any damage to or the loss of any package or the items contained therein.

ACCEPTANCE OF PACKAGES. Resident acknowledges and agrees that Xxxxxxxx does not accept packages on behalf of Resident, but has provided the lockers for Resident's use and arranged for Parcel Pending, an independent contractor vendor, to set up a package delivery system for residents at the property. Resident acknowledges that the lockers can be used only in connection with the approved package delivery system. Resident acknowledges that Resident's use of the lockers and package delivery system is at the sole discretion of Resident and that Resident's use and payment for the system will be governed by a separate agreement between Resident and the company that has set up the system. Landlord is not responsible for the conduct or performance of any package delivery company or system, a malfunction of any locker, or damaged, lost, stolen or misplaced packages. Resident gives permission to Landlord to return any and all packages not delivered through Parcel Pending.
ACCEPTANCE OF PACKAGES. Resident acknowledges that as a courtesy to Residents, Landlord will accept packages on Resident’s behalf that are delivered in Resident’s absence to the Business Office. Resident hereby authorizes Xxxxxxxx’s Business Office representatives to accept on Resident’s behalf any packages that are addressed to Resident and delivered to the Business Office due to Resident’s absence, and agrees to hold Landlord and such representatives harmless for signing for receipt of such packages and for any loss of or damage to the packages, except to the extent caused by the gross negligence or willful misconduct of such representatives.

  • Acceptance of Deliverables The State’s Project Manager shall be responsible for the sign-off acceptance of all Deliverables required and performed/submitted pursuant to this Agreement. Upon successful completion of a Deliverable, Contractor shall provide the State’s Project Manager with a completed Acceptance and Signoff Form (Exhibit E). The State’s Project Manager will apply the standards established in Exhibit D and the acceptance criteria set forth in subparagraph B of this article, as appropriate, to determine the acceptability of the Deliverable provided by Contractor. If the State’s Project Manager rejects the Deliverable, the parties agree to any dispute(s) resulting from such rejection(s) will be resolved as set forth in this article. Acceptance Criteria for Deliverables (“Criteria”) provided by Contractor pursuant to this Agreement include: Timeliness: The Work was provided on time; according to schedule; Completeness: The Deliverable contained all of the, Data, Materials, and features required by the Agreement; and Technical accuracy: The Deliverable complied with the standards of this Agreement, or, if this Agreement lacks a standard for provision of the Work, the currently generally accepted industry standard. Contractor shall provide the Deliverable to the State, in accordance with direction from the Project Manager and as provided for in Exhibit D. The State shall accept the Deliverable, provided that Contractor has delivered the Deliverable in accordance with the Criteria. The State’s Project Manager shall assign the Acceptance and Signoff Form to notify Contractor of the Deliverable’s acceptability. If the State rejects the Deliverable provided, the State’s Project Manager shall submit to Contractor’s Project Manager a written rejection describing in detail the failure of the Deliverable as measured against the Criteria. If the State rejects the Deliverable, then Contractor shall have a period of ten (10) Business Days from receipt of the Notice of rejection to correct the stated failure(s) to conform to the Criteria.
