Common use of ACCESS AND PARKING Clause in Contracts

ACCESS AND PARKING. The following statements are true with respect to each Mortgaged Property: (i) the Mortgaged Property is located on or adjacent to a public road, or has access to an irrevocable easement permitting ingress and egress and (ii) except for de minimus violations or legal non-conforming parking, to the Seller's knowledge, as of the time of origination of such Mortgage Loan, based upon a letter from governmental authorities, a legal opinion, an independent zoning consultant's report or an endorsement to the related title insurance policy insuring the holder of the Mortgage against losses related to the lack of such parking, and to Seller's actual knowledge as of the Closing Date, the Mortgaged Property has parking to the extent, if any, required under applicable law, including local ordinances.
