ACCESSES AND SECURITY. Subject to prevailing market conditions and applicable rules and regulations. AUSFOREX consent to Client's access and use in reliance upon his/her having adopted procedures to prevent unauthorized access to and use of the Online Service, and in any event, the Client agrees to any financial liability for trades executed through the Online Service. The Client acknowledges, represents and warrants that: He/She has received a number, code or other sequence, which provides access to the Online Service (“the Password”);
a) He/She is the sole and exclusive owner of the Password;
b) He/She is the sole and exclusive owner of any identification number or login number (“the Login”) ;
c) He/She accepts full responsibility for use and protections of the Password and the Login as well as for any transaction occurring in an account opened, held or accessed through the Login and/or Password. The Client accepts responsibility for the monitoring of his/her account(s). The Client will immediately notify AUSFOREX in mail if He/She becomes aware of any of the following:
a) Any loss, theft or unauthorized use of his/her Password(s), Login and/or account number(s);
b) Any failure by him/her to receive a message indicating that an order was received and and/or executed;
c) Any failure by him/her to receive an accurate confirmation of an execution;
d) Any receipt of confirmation of an order and/or execution, which he/she did not place;
e) Any inaccurate information in his/her account balances, positions, or transaction history.
ACCESSES AND SECURITY. The Online Service may be used to transmit orders/requests, receive and confirm execution of orders/requests, subject to prevailing market conditions and applicable rules and regulations. The Company consents to the Client’s access, in reliance with the safeguarding procedures, adopted by the Client for preventing unauthorized access to and use of the Online Service, and in any event, the Client agrees to any financial liability for transactions executed through the Online Service. The Client acknowledges, represents and warrants that:
a. The Client has received a number, code or other sequence which provides access to the Online Service (the "Password");
b. The Client is the sole and exclusive owner of the Password;
c. The Client is the sole and exclusive owner of any identification number or Account number or Login number (the "Login"); and
d. The Client accepts full responsibility for use and protection of the Password and the Login as well as for any transaction occurring in accounts opened, held or accessed through the Login and Password.
e. The Client agrees that the Company has the right to “reset” the Password, for security purposes, if the accounts have been inactive for a certain period of time. The Client accepts full responsibility for monitoring accounts’ activities. The Client agrees to immediately notify the Company in writing, should the Client become aware of any of the following:
a. any loss, theft or unauthorized use of the Client’s Password and/or Login number; or
b. any failure by the Client to receive a message indicating that an order/request was received and/or executed; or
c. any failure by the Client to receive an accurate confirmation of an execution; or
d. any receipt of confirmation of an order/request and/or execution of an order/request which the Client did not order/request; or
e. any failure to receive accurate information for the Client’s accounts balances, positions/transactions, or transaction history; or
f. any other reason whatsoever.

ACCESSES AND SECURITY. Except with the advanced written consent of DataBank, Customer’s access to the DataBank Data Centers will be limited solely to the Representatives as set forth in the Customer Registration Form which is hereby incorporated by reference into this MSA.

Except with the advanced written consent of VeriCenter, Customer’s access to the VeriCenter Data Centers will be limited solely to the Representatives as set forth in the Customer Registration Form which is hereby incorporated by reference into this MSA. Representatives may only access the VeriCenter Data Centers when accompanied by an authorized VeriCenter representative or with a properly issued VeriCenter access badge.
