Common use of Accident and Incident Investigations Clause in Contracts

Accident and Incident Investigations. (a) Every injury or near-miss which involved or would have involved a worker going to a doctor or hospital must be investigated. As well, incidents involving releases of hazardous substances into the air, earth or water systems must be investigated. (b) The Employer shall immediately notify the Ministry of Labour of all critical injuries. (c) The Employer shall immediately notify the Ministry of the Environment of all incidents involving a release of harmful substances into the air, earth or water systems. (d) Accident and incidence investigation reports shall conform with information required under the Act.
