Administrator’s Fees. The Producer shall pay the following fees to the Administrator:
Administrator’s Fees. A non-refundable application fee of $250.00 plus GST which may be deducted by the Administrator and paid from the Producer’s rebate claim.
Administrator’s Fees. Commencing on the first anniversary date of this Agreement or, as applicable, any amendments thereto, the Owner agrees to pay, without notice or demand, to the Administrator the annual fee of the Administrator in the amount of five thousand dollars ($5,000). In the event that any Administrator resigns or is terminated by the Agency, then, upon request by the Agency, the Owner agrees to use all reasonable efforts to (i) identify a replacement Administrator acceptable to the Agency, (ii) enter into an administration agreement with the Agency and such replacement Administrator, and (iii) pay the fee set forth above to any such replacement Administrator.
Administrator’s Fees. As part of Named Plaintiffs’ motion for final approval of the settlement, Named Plaintiffs will submit a declaration from the Administrator detailing the administration process, and will petition the Court for an award of administration fees and expenses to Simpluris, Inc. of Thirty Thousand Dollars and Zero Cents ($30,000.00), half of which shall be distributed from the Settlement Fund to the Administrator after the Court’s preliminary approval of the settlement. At the Fairness Hearing, Class Counsel will petition the Court to award the Administrator its fees and expenses to be paid out of the Settlement Fund. The Administrator’s fees and expenses of $30,000.00 shall be paid from the Settlement Fund. The substance of Class Counsel’s application for the Administrator’s fees and expenses is not part of this Agreement and is to be considered separately from the Court’s consideration of the fairness, reasonableness, adequacy, and good faith of the settlement of the Litigation. The outcome of any proceeding related to the request for Administrator costs and expenses shall not terminate this Agreement or otherwise affect the Court’s Final Approval. The Administrator fees and expenses shall be deducted from the Settlement Fund prior to distribution of any monies to the Class Members, FLSA Collective Members, Class Counsel and/or the Named Plaintiff.
Administrator’s Fees. The Depositor will pay, or cause to be paid, to the Administrator a fee in an amount agreed to by the Depositor and the Administrator as compensation for the services of the Administrator under this Agreement and as reimbursement for its costs and expenses to perform its obligations under this Agreement.
