Common use of Agenda Clause in Contracts

Agenda. (1) The person convening the Holders' Meeting shall make a proposal for resolution in respect of each item on the agenda to be passed upon by the Holders. (2) The agenda of the Holders' Meeting shall be published together with the Convening Notice. § 4(2) and (3) shall apply mutatis mutandis. No resolution may be passed on any item of the agenda which has not been published in the prescribed manner. (3) One or more Holders holding together not less than 5 per cent. of the outstanding Notes may require that new items are published for resolution. § 1(2) to (4) shall apply mutatis mutandis.
