Airshafts and Secondary Access. Tenant shall not mine or conduct any of the permitted uses on the surface of the Underground Leased Area, other than the installation of airshafts and a secondary access (emergency exit). It may be necessary intermittently during the Term of this Agreement for Tenant to install airshafts from the surface down to the Underground Leased Area. Landlord agrees to grant to Tenant easements to install, operate, maintain, repair, and replace airshafts from the surface down into the underground area. All access points and improvements shall be installed at Tenant’s sole cost and expense and shall be located so as not to materially impede or obstruct the development and use of the surface property or any improvements on the surface or unreasonably diminish the value of the Property. At the surface, all airshafts shall be covered by a secure grating or cap, painted, and surrounded by landscape bushes or other plantings, or otherwise camouflaged. Tenant, at its sole cost and expense, shall operate, maintain, repair, and replace all access points and, if requested by Landlord, upon the expiration or sooner termination of this Agreement shall cause any of the same to be filled and closed. If not so requested, they shall remain open to serve the future underground development. Tenant shall have the right at its sole cost and expense to have a secondary access to be used in emergency situations. The placement of the secondary access shall be made in consultation with Landlord and shall be constructed and landscaped as to minimally interfere with the current uses of the Property by Landlord. The secondary access shall be a low use point of access and will only be used to support and allow for safe development of the mine.

  • ROLE OF THE PRIMARY AND SECONDARY CONTACTS 5.01 Primary and Secondary Contact(s). The Resident, in executing this Agreement, is required to identify a “Primary Contact” and a “Secondary Contact”. It is strongly recommended that these contacts are parents or legal guardians of the Resident. The Primary Contact serves as the individual that is contacted by the Manager if concerns or problems arise with the Resident, as detailed in section 5.02 below. If the Primary Contact is not available, the Secondary Contact will be contacted.

  • Erosion and Sediment Control The Contractor shall install and maintain erosion and sediment control devices to prevent adjacent streets, storm drains and property from accumulations of soil, sediment, or dust which result from his work. Devices installed to control sediment and prevent erosion shall comply with the requirements of the Georgia Tech Project Superintendent. The Contractor is responsible for monitoring downstream conditions throughout the construction period and clearing any debris, sediment, and dust caused by the progress of the Work. The Contractor shall inspect, maintain, and clear erosion and sediment control devices at least weekly unless otherwise directed by the Georgia Institute of Technology Construction Manager. At the conclusion of the Work, the Contractor shall remove all installed devices and restoring the site to the satisfaction of the Georgia Tech Construction Manager.

  • Background Screening and Security 14 These General Contract Conditions supersede and replace in their entirety all General Contract Conditions, Form PUR 1000, which is incorporated by reference in Rule 60A-1.002, Florida Administrative Code (F.A.C.)

  • Consent to Contact Primary and Secondary Contact(s). In most circumstances, Residents will be treated without reference to their parents, guardians or primary/secondary contacts (i.e. student conduct situations). However, the Manager or the Institution may contact the Primary or Secondary Contact at any time and for any purpose, including, without limitation, to advise them of (i) any accident or injury to the Resident, (ii) overdue financial payments, (iii) termination of this Agreement, and/or (iv) any situation where the Resident may cause harm to themselves or to another, or (v) if the Resident is placed on Residence Probation or issued any behavioural contract or Eviction by the Manager. The Manager or the Institution may disclose the Resident’s personal information in such communications, and the Resident hereby consents to this disclosure.

  • DATA HANDLING AND SECURITY It will always be the responsibility of the selected Contractor to manage data transfer and to secure all data appropriately during the project to prevent unauthorized access to all data, products, and deliverables.

  • USE OF CITY FACILITIES The Association shall be permitted to use City facilities with prior Management approval for the purpose of holding meetings to the extent that such facilities are available to other organizations and individuals, and to the extent that such use of the facility will not interfere with normal departmental operations. Participating employees will attend said meetings on their own time unless other arrangements are made with management. If the use of a facility normally requires a fee for rental or special set-up, security, and/or cleanup service, the Association will provide or assume the cost of such service(s) or facility.

  • Use of Basement and Service Areas The basement(s) and service areas, if any, as located within the (project name), shall be earmarked for purposes such as parking spaces and services including but not limited to electric sub-station, transformer, DG set rooms, underground water tanks, pump rooms, maintenance and service rooms, fire fighting pumps and equipment's etc. and other permitted uses as per sanctioned plans. The Allottee shall not be permitted to use the services areas and the basements in any manner whatsoever, other than those earmarked as parking spaces, and the same shall be reserved for use by the association of allottees formed by the Allottees for rendering maintenance services.

  • Use of University Facilities Members may use the office assigned to them in connection with such professionally-related activities as preparation of professional manuscripts and materials, scholarly endeavors, approved consultancies, and service to professional associations, schools, or other groups or agencies for whom such service is appropriate. Upon request, faculty may use laboratories and studios for non-sponsored research and other scholarly activity. Upon request, faculty may use meeting rooms and other physical facilities for professionally-related groups subject to availability and prevailing policies of the University governing use of facilities. The facilities of the TRC, Print Shop, computer labs and the use of University equipment are available to the faculty in connection with professional writing, research, or approved service projects subject to availability and to reimbursement at prevailing rates charged by the University.

  • GEOGRAPHIC AREA AND SECTOR SPECIFIC ALLOWANCES, CONDITIONS AND EXCEPTIONS The following allowances and conditions shall apply where relevant: Where the company does work which falls under the following headings, the company agrees to pay and observe the relevant respective conditions and/or exceptions set out below in each case.

  • DELIVERY, STORAGE, AND HANDLING The Contractor shall be responsible to inspect all components on delivery to ensure that no damage occurred during shipping or handling for furnish and installation projects. For equipment only purchases, the ordering entity shall be responsible to inspect all components on delivery. Materials must be stored in original undamaged packaging in such a manner to ensure proper ventilation and drainage, and to protect against damage, weather, vandalism, and theft until ready for installation.
