Common use of ALCOHOLISM, DRUG ABUSE AND MENTAL ILLNESS Clause in Contracts

ALCOHOLISM, DRUG ABUSE AND MENTAL ILLNESS. The Employer recognizes that alcoholism, drug addiction and mental illness are illnesses which can respond to therapy and treatment. An employee so affected shall: (a) Recognize his/her obligation to seek recognized medical treatment when his/her illness has an adverse affect on his/her ability to satisfactorily perform the regular duties assigned to him/her, and (b) Agree to faithfully maintain any course of recognized medical treatment or therapy prescribed for him/her. If the employee does not respond to treatment within a reasonable period of time or the employee is unable to satisfactorily perform the regular duties assigned to him/her following treatment, the Employer shall have the right to terminate the employee subject to the grievance and arbitration procedure.
