Allowance for Unsuitable Soil. 10.2.1 The Task Order for a Construction Work Package may include an allowance for the removal of unsuitable soil. If it does, the allowance amount will be specifically stated in the Task Order and it will be included in the Task Order Price. 10.2.2 The Contractor and Authority agree that any allowance amount for the removal of unsuitable soil that is included in a Task Order will be a reasonable estimate for the removal of the unsuitable soil. If the Task Order for a Construction Work Package includes an allowance for the removal of unsuitable soil, the Contractor shall obtain the Authority’s advance written authorization before proceeding with the removal of unsuitable soil. Further: (a) Any allowance amount for the removal of unsuitable soil includes all direct costs to the Contractor to remove the unsuitable soil; and (b) All overhead, profit and other items associated with the removal of unsuitable soil are included in the Task Order Price but not in the allowance amount, and are not subject to adjustment, regardless of the actual cost incurred by the Contractor to remove the unsuitable soil. 10.2.3 If the Task Order for a Construction Work Package includes an allowance for the removal of unsuitable soil, and if the Contractor’s actual direct cost to remove the unsuitable soil is more than or less than the stated allowance amount, the Task Order Price for that Task Order shall be adjusted accordingly by a Contract Modification. The amount of the Contract Modification shall reflect the difference between the direct costs the Contractor actually incurred to remove the unsuitable soil and the allowance amount. Further, prior to the issuance of any such Contract Modification, the Contractor shall provide the Contracting Officer written documentation substantiating the quantity of unsuitable soil that was removed.

  • Special Parental Allowance for Totally Disabled Employees (a) An employee who: (i) fails to satisfy the eligibility requirement specified in subparagraph 17.05(a)(ii) solely because a concurrent entitlement to benefits under the Disability Insurance (DI) Plan, the Long-term Disability (LTD) Insurance portion of the Public Service Management Insurance Plan (PSMIP) or via the Government Employees Compensation Act prevents the employee from receiving Employment Insurance or Québec Parental Insurance Plan benefits, and (ii) has satisfied all of the other eligibility criteria specified in paragraph 17.05(a), other than those specified in sections (A) and (B) of subparagraph 17.05(a)(iii), shall be paid, in respect of each week of benefits under the parental allowance not received for the reason described in subparagraph (i), the difference between ninety-three per cent (93%) of the employee's rate of pay and the gross amount of his or her weekly disability benefit under the DI Plan, the LTD Plan or via the Government Employees Compensation Act. (b) An employee shall be paid an allowance under this clause and under clause 17.05 for a combined period of no more than the number of weeks during which the employee would have been eligible for parental, paternity or adoption benefits under the Employment Insurance or Québec Parental Insurance Plan, had the employee not been disqualified from Employment Insurance or Québec Parental Insurance Plan benefits for the reasons described in subparagraph (a)(i).

  • Method of Billing Consultant may submit invoices to the City for approval on a progress basis, but no more often than two times a month. Said invoice shall be based on the total of all Consultant’s services which have been completed to City’s sole satisfaction. City shall pay Consultant’s invoice within forty-five (45) days from the date City receives said invoice. Each invoice shall describe in detail, the services performed, the date of performance, and the associated time for completion.
