Alternative Contractor. If the in-zone Contractor cannot arrive at the location of a vehicle to be impounded within the appropriate time specified in Section 5.3, the SPD Communications Section—911 Center may select the nearest out-of-zone Contractor to impound the vehicle and tow it to the out-of-zone Contractor's primary storage lot at its Contract rate. In no event shall a person claiming a vehicle so impounded pay more than the lower of the in-zone or out-of-zone Contract Extension rate. In the event the out-of-zone Contract Extension rate is higher than the in-zone Contract Extension rate, the in-zone Contractor shall pay the difference between the two Contract Extension rates to the out-of-zone Contractor. A person redeeming the vehicle must be provided taxicab transportation, at the in-zone Contractor’s expense, from the in-zone Contractor’s primary lot to the out-of-zone Contractor’s primary lot within twenty (20) minutes of his/her arrival at the in-zone Contractor’s lot.

Alternative Contractor. In the event the Contractor does not believe they will meet the specified delivery date at the time of quote the State agency or CPV member can decide whether to accept an agreed upon revised shipment date, cancel the shipment order or utilize an alternate contractor on the contract. If MnDOT, the state agency or CPV member decide to utilize another contractor on the contract they will notify the contractor in writing.

  • Cooperative Contract The provisions and pricing of this Contract will be extended to other California local or state governmental entities. Governmental entities wishing to use this Contract will be responsible for issuing their own purchase documents/price agreements, providing for their own acceptance, and making any subsequent payments. Contractor shall be required to include in any Contract entered into with another agency or entity that is entered into as an extension of this Contract a Contract clause that will hold harmless the County of Orange from all claims, demands, actions or causes of actions of every kind resulting directly or indirectly, arising out of, or in any way connected with the use of this contract. Failure to do so will be considered a material breach of this Contract and grounds for immediate Contract termination. The cooperative entities are responsible for obtaining all certificates of insurance and bonds required. The Contractor is responsible for providing each cooperative entity a copy of the Contract upon request by the cooperative entity. The County of Orange makes no guarantee of usage by other users of this Contract. The Contractor shall be required to maintain a list of the cooperative entities using this Contract. The list shall report dollar volumes spent annually and shall be provided on an annual basis to the County, at the County’s request.

Definitions: Covered employees: Employees of a contractor or subcontractor who have or will have continuing duties related to the service to be performed at the District and have or will have direct contact with students. The District will be the final arbiter of what constitutes direct contact with students. Disqualifying criminal history: Any conviction or other criminal history information designated by the District, or one of the following offenses, if at the time of the offense, the victim was under 18 or enrolled in a public school: (a) a felony offense under Title 5, Texas Penal Code; (b) an offense for which a defendant is required to register as a sex offender under Chapter 62, Texas Code of Criminal Procedure; or (c) an equivalent offense under federal law or the laws of another state.   • SUB-CONTRACTOR Section 1. The Employer shall not contract any work covered by this Agreement to be done at the site of construction, alterations, repairs or any new construction to any person, firm or company that does not have an existing labor agreement with the Union covering such work within the scope of this Agreement.

  • Prime Contractor Upon execution of this Agreement, the CNA may perform as the prime contractor only when qualified NPAs do not have the capacity to perform the service, or when the government customer requests this arrangement, unless prior approval is received from the Commission. The CNA shall only serve as the prime contractor to manage subcontracts and allocate orders equitably when approved by the Commission. The intent of this provision is for CNAs to support NPAs’ ability to do business with the government and shall not unnecessarily compete with the NPAs. The CNA shall not charge a Program Fee from any NPAs serving as subcontractors. The CNA shall not charge any fees unallowable by law or regulation when serving as the prime contractor. Annually, no later than October 31, the CNA shall submit a list of all federal contracts where the CNA serves as the prime contractor. Within the submitted documentation, the CNA must explain why it is the prime contractor and provide a plan (to include milestones) to phase-out as a prime and phase-in an NPA.
