Lessor appoints Lessee as Lessor’s lawful Attorney In Fact for the purpose of the location, amendment or relocation of any such claims. All amended or new locations shall be part of the mining claims subject to this Agreement, and the parties will promptly, after amendment or location of such claims, execute and deliver an addendum to this Agreement, and an amended memorandum of this Agreement to such effect.

Amendment and Relocation of Claims. The right, in Lessee’s sole discretion, to amend or relocate as unpatented mining claims or mill sites, in the name of Lessor, any unpatented mining claims or mill sites included in the Premises. If Lessee undertakes any such amendment or relocation, Lessee shall use its best efforts to complete the same in compliance with applicable statutes and regulations but shall not be liable to Lessor for any act (or failure to act) by it or any of its agents in connection with the amendment or relocation of mining claims or mill sites unless such act (or omission) arises from gross negligence or is made in bad faith. Amendment and Relocation of Claims. On not less than ten (10) days notice to and after consultation with Owner, Paradigm shall have the right to amend or relocate in the name of Owner any of the unpatented mining claims subject to this Agreement which Paradigm deems advisable to so amend or relocate and the right to abandon any unpatented mining claims subject to this Agreement and to relocate the lands formerly appropriated by such abandoned mining claims as mill sites. Subject to the provisions in this Section, Owner appoints Paradigm as Owner’s lawful attorney in fact for the purpose of the location, amendment or relocation of any such claims. All amended or new locations shall be part of the mining claims subject to this Agreement and the parties will promptly after amendment or location of such claims execute and deliver an addendum to this Agreement and an amended memorandum of this Agreement to such effect.
Amendment and Relocation of Claims. On not less than twenty (20) days advance notice to Owner, Miranda shall have the right to amend or relocate as unpatented lode mining claims in the name of Owner any of the unpatented mining claims subject to this Agreement which Xxxxxxx xxxxx advisable to so amend or relocate, provided that Miranda shall preserve and protect Owner's Royalty interest in any such amended or relocated claims.   • Separation Agreement and Release of Claims The Executive’s receipt of any severance payments or benefits upon the Executive’s Qualifying Termination under Section 3 is subject to the Executive signing and not revoking the Company’s then-standard separation agreement and release of claims (which may include an agreement not to disparage any member of the Company Group, non-solicit provisions, an agreement to assist in any litigation matters, and other standard terms and conditions) (the “Release” and that requirement, the “Release Requirement”), which must become effective and irrevocable no later than the sixtieth (60th) day following the Executive’s Qualifying Termination (the “Release Deadline”).   • Release of Claims Agreement The receipt of any severance payments or benefits pursuant to this Agreement is subject to Executive signing and not revoking a separation agreement and release of claims in a form mutually acceptable to the Company and Executive (the “Release”), which must become effective no later than the sixtieth (60th) day following Executive’s termination of employment (the “Release Deadline”), and if not, Executive will forfeit any right to severance payments or benefits under this Agreement.
