Amendment to Mortgage. The Mortgage is hereby amended to reflect the resignation of Societe Generale as Administrative Agent and its replacement in such capacity by Bank One, NA as successor Administrative Agent under the Credit Agreement, as amended, and pursuant to the terms of the Agency Assignment Agreement dated as of June 29, 2001 as follows:
Amendment to Mortgage. On or before January 24, 2020 the Borrower shall have delivered to the Administrative Agent an executed amendment to the Mortgage in form and substance satisfactory to the Administrative Agent, which amendment shall increase the amount of indebtedness secured thereby to $11,000,000.
Amendment to Mortgage. The Mortgage is modified to secure the Note as hereby modified and is deemed amended to conform to the terms and provisions hereof and the amendments and modifications to the Loan and Loan Documents effected hereby.
Amendment to Mortgage. For good and valuable consideration, receipt of which is hereby acknowledged, PRAB, INC., formerly known as Prab Robots, Inc., a Michigan corporation, whose address is 0000 Xxxx Xxxxxxx Xxxx, Kalamazoo, Michigan 49003 (herein collectively referred to as "Mortgagor"), and FMB-ARCADIA BANK, formerly Arcadia Bank, a Michigan banking corporation, 000 Xxxx Xxxxxxxx Xxxxxx, Xxxxxxxxx 00000 ("Bank") hereby amend and modify the Future Advance Mortgage between Mortgagor and the Bank dated October 30, 1992, and recorded on November 2, 1992, in Liber 1599, Pages 0464-0468, Kalamazoo County Records, (the "Mortgage") by adding the following language as paragraph 29 thereof:
Amendment to Mortgage. Security Agreement and Financing Statement (Wyoming) between the Borrower and the Agent
Amendment to Mortgage. The Administrative Agent shall have received the First Amendment to Mortgage, duly completed and executed by Borrower, along with (i) an opinion of counsel to Borrower in Illinois dated as of the Notes Offering Issuance Date addressed to the Administrative Agent, the Issuing Banks and the Lenders and covering such matters as the Administrative Agent, the Issuing Banks or the Lenders may reasonably request in connection with the First Amendment to Mortgage, and (ii) a draft title endorsement approved by the issuing title company with respect to the First Amendment to Mortgage in form and substance reasonably satisfactory to the Administrative Agent with respect to the title policy issued in connection with the existing Mortgage.
Amendment to Mortgage. Security Agreement, Fixture Filing and Assignment of Rents and Leases dated as of December 19, 2006, by Mortgage Borrower to Mortgage Loan Administrative Agent.
Amendment to Mortgage. On or before January 31, 1999, Borrower shall execute and deliver to Bank a Third Amendment to Mortgage in the form of Exhibit D attached hereto."
Amendment to Mortgage. The Mortgage shall be amended to reflect the extension of the maturity date of the Restated Revolving Note to December 31, 2007. The Mortgage shall now secure the Revolving Note, as amended by the Restated Revolving Note, which evidences a maximum outstanding principal balance permitted thereunder of Twelve Million and 00/100 Dollars ($12,000,000.00).
Amendment to Mortgage. An Amendment to the Mortgage in form and substance acceptable to the Bank duly executed by the Borrower, a date down endorsement to the title insurance policy in favor of the Bank relating to the Premises and all documents or items required by the title insurance company issuing such date down endorsement in connection therewith.
