Applicable Standards. On Port property, the City’s Critical Areas regulations (SeaTac Municipal Code Chapter 15.700), as those regulations exist on the date of this Agreement, shall apply except for the following: 1. Mitigation projects/sites established under Clean Water Act Section 404 Permit #0000-00-00000 (Amended-2) and the associated Washington State Department of Ecology Section 401 Certification. 2. Future development projects requiring Washington State Hydraulic Project Approval, Section 401 Water Quality Certifications and/or Section 404 permits and associated compensatory mitigation.
