Common use of Application of Layoff Provisions Clause in Contracts

Application of Layoff Provisions. If at the end of the disability leave the employee's medical condition is such that the employee is unable to fulfill the functions of the employee’s position and cannot be accommodated under the provisions of Article 39, then the employee may be laid off in accordance with Article 36.
