Appointment of a Mediator. (1) Upon its General Secretary’s reasoned proposal, the CMCC Administrative Board appoints the mediator in charge of a dossier based on the list of mediators accredited by the CMCC. This choice is based on the dispute’s nature, the mediator’s qualifications, and experience as well as the preferences expressed by the parties. (2) During the mediation meetings, the CMCC might pro- pose to the parties to have a person participate who is being trained as mediator. In case of the parties’ agreement, this person must adhere to the same ob- ligation of confidentiality as the mediator.
Appointment of a Mediator. If the issue remains unresolved after the procedure in clause 27(a) has been followed then the dispute or difference shall be referred by both parties to a suitably qualified independent mediator for settlement. The mediator shall be appointed by agreement between the parties or in default of agreement by the duly authorised officer of the Trust’s Regulator. The mediation will be conducted in accordance with the requirements of the mediator. Any costs shall be borne as the mediator directs.

  • Appointment of Agent GE Capital is hereby appointed to act on behalf of all Lenders as Agent under this Agreement and the other Loan Documents. The provisions of this Section 9.2 are solely for the benefit of Agent and Lenders and no Credit Party nor any other Person shall have any rights as a third party beneficiary of any of the provisions hereof. If Agent shall request instructions from Requisite Lenders or all affected Lenders with respect to any act or action (including failure to act) in connection with this Agreement or any other Loan Document, then Agent shall be entitled to refrain from such act or taking such action unless and until Agent shall have received instructions from Requisite Lenders or all affected Lenders, as the case may be, and Agent shall not incur liability to any Person by reason of so refraining. Agent shall be fully justified in failing or refusing to take any action hereunder or under any other Loan Document (a) if such action would, in the opinion of Agent, be contrary to law or the terms of this Agreement or any other Loan Document, (b) if such action would, in the opinion of Agent, expose Agent to Environmental Liabilities or (c) if Agent shall not first be indemnified to its satisfaction against any and all liability and expense which may be incurred by it by reason of taking or continuing to take any such action. Without limiting the foregoing, no Lender shall have any right of action whatsoever against Agent as a result of Agent acting or refraining from acting hereunder or under any other Loan Document in accordance with the instructions of Requisite Lenders or all affected Lenders, as applicable.

In the event that the competent authority of a Contracting State fails to appoint a member of the arbitration panel in the manner and within the time periods specified in paragraph 2 or agreed to by the competent authorities of the Contracting States, a member shall be appointed on behalf of that competent authority by the highest ranking official of the Centre for Tax Policy and Administration of the Organisation for Economic Co-operation and Development that is not a national of either Contracting State. 4. If the two initial members of the arbitration panel fail to appoint the Chair in the manner and within the time periods specified in paragraph 2 or agreed to by the competent authorities of the Contracting States, the Chair shall be appointed by the highest ranking official of the Centre for Tax Policy and Administration of the Organisation for Economic Co-operation and Development that is not a national of either Contracting State.
