Architect’s Agreement. Borrower and Architect have entered into the Architect's Agreement, pursuant to which Architect is to design the Improvements. Borrower shall require Architect to perform in accordance with the terms of the Architect's Agreement and shall not amend, modify or alter the Architect's Agreement without Lender's prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed. Upon Lender's request, Borrower shall execute an assignment of the Architect's Agreement and the Plans and Specifications to Lender as additional security for Borrower's performance under this Agreement and the other Loan Documents and shall cause the Architect to consent to any such assignment.
Architect’s Agreement. The agreement between Borrower and Architect relating to the design and construction of the Improvements.
Architect’s Agreement. Borrower and Architect have entered into the Architect’s Agreement, pursuant to which Architect is to design the Improvements. Borrower shall require Architect to perform in accordance with the terms of the Architect’s Agreement and shall not amend, modify or alter the material responsibilities of Architect under the Architect’s Agreement without Administrative Agent’s prior written consent, such consent not to be unreasonably withheld, conditioned or delayed. Upon Administrative Agent’s request, Borrower shall execute an assignment of the Architect’s Agreement and the Plans and Specifications to Administrative Agent, for the benefit of Lenders, as additional security for Borrower’s performance under this Agreement and the other Loan Documents and shall cause the Architect to consent to any such assignment.
Architect’s Agreement. A copy of the fully executed Architect’s Agreement.
Architect’s Agreement. Borrower and The Housing Studio (“Architect”) have entered into that certain AIA Standard Form of Agreement Between Owner and Architect dated December 1, 2010 (the “Architect’s Agreement”), pursuant to which Architect is to design the Improvements. Borrower shall require Architect to perform in accordance with the terms of the Architect’s Agreement and shall not amend, modify or alter the responsibilities of Architect under the Architect’s Agreement without Lender’s prior written consent. Upon Lender’s request, Borrower shall execute an assignment of the Architect’s Agreement and the Plans and Specifications to the extent prepared by Architect, to Lender as additional security for Borrower’s performance under this Agreement and the other Loan Documents and shall cause Architect to consent to any such assignment.
Architect’s Agreement. The Architect's Agreement between Xxxxxxxx and Xxxxxxx and Associates dated March 22, 2000 is the only agreement in effect on the date hereof with respect to the Project.
Architect’s Agreement. Borrower shall not enter into any Architect’s Agreement without Lender’s prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed. As a condition to approval of any such Architect’s Agreement, Lender may require that Borrower assign its rights under such agreement to Lender as security for Borrower’s obligations under this Agreement and the other Loan Documents. Any such assignment shall be on the form of Assignment of Architect’s Agreement attached hereto as Exhibit G, and shall be consented to by the applicable Architect, including any modifications to such form reasonably requested by such Architect and consented to by Lender. Borrower shall require each Architect to perform in accordance with the terms of the applicable Architect’s Agreement and shall not materially amend, modify or alter the responsibilities of any Architect under any Architect’s Agreement without Lender’s prior written consent.
Architect’s Agreement. Borrower and XXXX X. XXXXXXX, III ARCHITECTS, INC., a Texas corporation (“Architect”), have entered into that certain Letter Agreement dated as of April 12, 2013 (the “Architect’s Agreement”) pursuant to which Architect is to design the Improvements. Borrower shall require Architect to perform in accordance with the terms of the Architect’s Agreement and shall not amend, modify or alter the material responsibilities of Architect under the Architect’s Agreement without Lender’s prior written consent. Upon Lender’s request, Borrower shall execute an assignment of the Architect’s Agreement and the Plans and Specifications to the extent prepared by Architect, to Lender as additional security for Borrower’s performance under this Agreement and the other Loan Documents and shall cause Architect to consent to any such assignment.
Architect’s Agreement. That both Borrower and Architect are in full compliance with their respective obligations under the Architectural Contract. Borrower shall from time to time upon request by Lender cause Architect to provide Lender with reports relative to the status of construction of the Improvements.
Architect’s Agreement. (19) To the extent available, a list of all subcontractors including license number, address, contract name, telephone number, general statement of the nature of work to be done, and the approximate dollar amount of the contract.
