Common use of Association Right of Notification Clause in Contracts

Association Right of Notification. If the District desires to request that a bus driver participate in an unannounced drug and/or alcohol test under Section B.1.d above, the Association shall have the right to notification not less than one-half (1/2) hour prior to testing, and an opportunity to be present to counsel with the employee, if the employee desires Association presence.

Association Right of Notification. ‌ If the District desires to request that a bus driver or commercial vehicle driver who drives a commercial vehicle in the capacity of their employment with the District participate in an unannounced drug and/or alcohol test under Section B.1.d above, the Association shall have the right to notification not less than one-half (1/2) hour prior to testing, and an opportunity to be present to counsel with the employee, if the employee desires Association presence. This provision does not apply to testing required by the Federal Motor Carrier Safety Administration.
