Attendance in Court. A. Absence in Response to Subpoena or Jury Summons 1. A bargaining unit member who is summoned for jury duty during normal teaching hours and who is subpoenaed to appear in a court for school purposes will be granted a leave of absence from normal teaching duties to permit compliance, provided the bargaining unit member meets the following: a. Notifies the Superintendent within two (2) days after receipt of the jury summons or subpoena. b. Submits a statement signed by the bargaining unit member to the Treasurer stating the following: (1) date and time in attendance at the proceeding (2) actual amount of compensation which was received as a result of the appearance or, if no compensation was received, a statement so stating c. The amount of any witness fee or other compensation, except that which is paid specifically for expenses incurred by reason of the subpoena or summons, must be remitted by the bargaining unit member to the office of the Treasurer before the end of the pay period in which the absence occurred. 2. In court cases in which the bargaining unit member's presence is required, the Superintendent may authorize absence with no loss of salary in accordance with the provisions of this section. The decision of the Superintendent with respect to such matters shall be final.
