Australian Consumers. This Section 8 applies if You obtain the Software in Australia. If a supply under this XXXX is a supply of goods or services to a consumer within the meaning of the Australian Consumer Law, nothing contained in this XXXX excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or any other statute where to do so would contravene that statute or cause any term of this XXXX to be void ("Non-Excludable Obligations"). To the extent permitted by law, Liferay's liability in relation to Non-Excludable Obligations is limited to (at Liferay's option): (i) in the case of services, the cost of supplying the services again or payment of the cost of having the services supplied again; and (ii) in the case of goods, the cost of replacing the goods, supplying equivalent goods or having the goods repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

Australian Consumers. If the Purchaser is a consumer for the purposes of Schedule 2 of the Competition and Consumer Xxx 0000 (Cth) (“Australian Consumer Law”)) under which Purchaser has statutory rights, this Product Warranty is in addition to the Purchaser’s rights under the Australian Consumer Law and does not affect Purchaser’s rights under that legislation. In this case, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.   • Australian Consumer Law To the extent you are located in Australia: The supply of the Products or Services under this Agreement may be subject to the Australian Consumer Law, Schedule 2 of the Australian Competition and Consumer Xxx 0000 (Cth) ("Australian Consumer Law"). Where this is the case, the following statement applies in respect of any failure to comply with the consumer guarantees under the Australian Consumer Law: Our Products and Services come with guarantees that cannot be excluded under the Australian Consumer Law. Where the Australian Consumer Laws apply, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, subject to the limitation of liability below.
