Authority Responsibility Commencing on Operations Date. The Authority, consistent with its obligations under the Authority Joint Powers Agreement, shall use its best efforts, including its statutory and contractual authority, to cause Mixed Municipal Waste in each member jurisdiction that remains for disposal and is collected by the jurisdiction or its authorized contractor following operation of each member jurisdiction’s diversion programs (whether operated by the jurisdiction or by a contractor), including, but not limited to recycling, composting, reuse, source reduction, and all other methods of processing and diverting materials) to be Delivered to the Facility commencing on the Operations Date. However, nothing in this Agreement shall be construed to mean that the Authority makes any guarantee regarding the fitness, quality, constituency, or quantity of Mixed Municipal Waste Delivered to the Facility. The Authority is not responsible for any reduction in quantities due to increases in diversion achieved by member jurisdictions. In addition, the Authority is not responsible for a reduction in Mixed Municipal Waste resulting from a Member Agency’s withdrawal from the Authority in accordance with the provisions of the Joint Powers Agreement.

  • Fiscal Responsibility It is understood and agreed that the total amount of the funds used under this Agreement shall be used only for the project as described in the application and award documentation. Therefore, should the project not be completed, the Subrecipient shall reimburse said funds directly to the AZDOHS immediately. If the project is completed at a lower cost than the original budget called for, the amount reimbursed to the Subrecipient shall be for only the amount of dollars actually spent by the Subrecipient in accordance with the approved application.
