Common use of Availability of Benefits Clause in Contracts

Availability of Benefits. Consistent with that intent, before expending any amounts from the net income and/or principal of a Trust Account, the Trustee shall consider the availability of all benefits from government or private assistance programs for which the Designated Beneficiary may be eligible. It is the Trustee’s intention to maximize wherever possible, the collection and facilitate the distribution of these benefits.
