Beneficiary Power of Appointment Sample Clauses

Beneficiary Power of Appointment. Except as the appointment of a beneficiary’s interest may be otherwise limited elsewhere in this Agreement, the Settlor grants to every remainder beneficiary the following powers of appointment with regard to that beneficiary’s interest in Trust Property, which powers must be exercised by specific reference thereto in the beneficiary’s Last Will and Testament as admitted to probate. It is the Settlor’s intent that exercise of any such appointment shall become effective upon the death of the beneficiary, except that, if the beneficiary predeceases an intervening beneficiary, the enjoyment of the interest thus appointed shall be suspended until the death of that intervening beneficiary, and shall also be subject to any existing right of the intervening beneficiary to enjoy, consume or otherwise dispose of Trust Property to which the interest appointed would attach. Therefore, the powers of appointment hereby granted are as follows:
