Bid Phase. The ARCHITECT/ENGINEER, following the OWNER'S approval of the Construction Documents and the estimate of Construction Costs, will assist the OWNER and CONTRACTOR in obtaining bids or negotiated proposals and in awarding and preparing construction contracts. The ARCHITECT/ENGINEER will be present on the occasion of any pre-bid conference and bid opening for the Project. The ARCHITECT/ENGINEER in coordination with OWNER, will respond to questions from bidders, and will issue addenda. 1. The ARCHITECT/ENGINEER will assist the OWNER with printing and distributing plans and specifications for bidding purposes. 2. The ARCHITECT/ENGINEER will provide to the OWNER a set of electronic reproducible drawings and specifications for the OWNER’S use in printing and distribution. 3. The ARCHITECT/ENGINEER will assist the OWNER in evaluating the project bids and provide a letter evaluating the low responsible bid. 4. In the event that the lowest bona fide bid for the Work is in excess of the estimate of Construction Cost provided by the ARCHITECT/ENGINEER at the completion of the Construction Document Phase, the OWNER may: a. Give written approval of an increase in the previously approved estimate of Construction Cost; or b. In conjunction with the ARCHITECT/ENGINEER, evaluate the project at no additional cost to the OWNER, to determine if change orders can be initiated to allow the work to be accomplished within the estimate of the Construction Cost; or c. Authorize re-bidding or renegotiating of the Project within a reasonable time; or d. Cooperate with the ARCHITECT/ENGINEER who will revise the Project scope and/or Construction Documents, as directed by the OWNER and at no additional cost to the OWNER, on a timely basis so that bids or proposals may be received within the estimate of Construction Cost at the completion of the Construction Document Phase; or e. Terminate this Agreement in accordance with Section II, Article 4.4, and compensate the ARCHITECT/ENGINEER for services performed prior to termination, excluding Termination Expenses.

Bid Phase. A. The ARCHITECT/ENGINEER, following Consultant shall attend the OWNER'S approval of the Construction Documents and the estimate of Construction Costs, will assist the OWNER and CONTRACTOR in obtaining bids or negotiated proposals and in awarding and preparing construction contracts. The ARCHITECT/ENGINEER will be present on the occasion of any pre“Pre-bid conference Conference” for each Project and bid opening for shall provide assistance to Xxxxxxxx in responding to inquiries by the Projectprospective bidders during the bidding period. Bidding is anticipated to occur in October - November 2020.
B. The ARCHITECT/ENGINEER in coordination with OWNER, will respond Consultant shall prepare all necessary corrections and additional information based on prospective bidder inquiries. All answers to questions from bidders, shall be coordinated with Xxxxxxxx and issued by Xxxxxxxx. Consultant shall not respond directly to any prospective bidder or subcontractor during the bid phase. Consultant shall assist Xxxxxxxx with preparation of addenda. Xxxxxxxx will issue all addenda.
1C. The Consultant shall assist Xxxxxxxx in the review of bids received and the qualification of bidders as deemed appropriate by Xxxxxxxx.
D. If more than one hundred eighty (180) Calendar days have elapsed between the date of the Consultant’s most recent Estimate of Probable Construction Cost and the date of the bid submission, the Estimate of Probable Construction Cost total shall be adjusted for inflation based on the Engineering News Record Construction Cost Index for Denver. The ARCHITECT/ENGINEER will assist adjusted estimate shall be used as the OWNER with printing basis for evaluating the bids and distributing plans and specifications for bidding purposesthe Project budget.
2E. Should the bid of the lowest responsive and responsible bidder exceed the Consultant’s Estimate of Probable Construction Cost, Xxxxxxxx and the Consultant shall explore options, including but not limited to awarding the Project as designed if sufficient budget contingency is available, evaluating design alternatives and estimates of related cost savings to bring the Project back within budget, and re-designing and re-bidding. The ARCHITECT/ENGINEER Xxxxxxxx, at its sole option, will provide determine the course of action to the OWNER a set of electronic reproducible drawings and specifications for the OWNER’S use in printing and distributiontake.
3. The ARCHITECT/ENGINEER will assist F. If the OWNER in evaluating bid exceeded the project bids and provide a letter evaluating the low responsible bid.
4. In the event that the lowest bona fide bid for the Work is in excess of the Consultant’s estimate of Construction Cost provided by probable construction cost, as adjusted for inflation if applicable, and should Xxxxxxxx choose to re-design and re-bid the ARCHITECT/ENGINEER at the completion of the Construction Document PhaseProject, the OWNER may:
a. Give written approval of an increase Consultant shall prepare revised contract documents as required, and shall assist in the previously approved estimate of Construction Cost; or
b. In conjunction with the ARCHITECT/ENGINEERre-bidding phase, evaluate the project all at no additional cost to the OWNER, Xxxxxxxx. Should Xxxxxxxx choose to determine if change orders can be initiated to allow the work to be accomplished within the estimate of the Construction Cost; or
c. Authorize re-bidding or renegotiating of award the Project within a reasonable time; or
d. Cooperate without rebidding, the Consultant shall cooperate with the ARCHITECT/ENGINEER who will revise the Project scope and/or Construction Documents, selected contractor and assist in preparation of “Proposal Requests” as directed by Xxxxxxxx to reduce the OWNER and Project cost to within budget, all at no additional cost to Xxxxxxxx.
G. At the OWNER, on a timely basis so that bids or proposals may be received within the estimate of Construction Cost at the completion end of the Construction Document Bid Phase; or
e. Terminate this Agreement , the Consultant shall make final revisions to the contract documents based on addenda issued during the Bid Phase. Drawing revisions shall be indicated by encircling addenda changes with “clouds” and including a delta indicating the addendum number. All addenda dates and delta numbers shall also be indicated in accordance the revision block on each sheet. Project Manual addenda revisions shall be denoted by striking through deleted text and italicizing added text with Section II, Article 4.4, the addendum number noted in parentheses immediately following each text revision. The Project Manual index shall indicate those sections that contain addenda revisions by placing an asterisk next to the section number in the Index/Table of Contents. The Consultant shall provide revised reproducible and compensate electronic documents to Xxxxxxxx within ten (10) Calendar Days following the ARCHITECT/ENGINEER opening of the bids. Issue block shall read “For Construction” and shall be dated as of the general contractor’s date of Notice of Award. Xxxxxxxx will issue the “For Construction” documents to the successful general contractor for services performed prior use during the construction phase. Consultant shall be responsible for the cost of printing and distributing hard copies of the “For Construction” documents to termination, excluding Termination Expensesthemselves and their Subconsultants.
