Design Phase. During its design phase, Specialty Subcontractor shall meet with Construction Manager and Owner Parties as requested to coordinate preparation of the Construction Drawings and Specifications. During those meetings, Specialty Subcontractor shall furnish the Project Design Team with recommendations for: (i) construction feasibility; (ii) Materials and labor availability, including analysis of the types and quantities of labor required for the applicable trade work; (iii) procurement and lead-time, and (iv) other cost-reduction measures, including Value Engineering. Specialty Subcontractor shall work with the Project Development Team to design the relevant portions of the Work, through approval of the Construction Drawings and Specifications, to ensure the cost of such Work shall be at most equal to its awarded bid price. Specialty Subcontractor shall promptly notify the Project Development Team of any material changes to quantities or qualities that affect the cost or schedule included in its bid and shall provide detailed information of such changes for Owner Parties’ and Construction Manager’s review.
Design Phase. In conjunction with the design phase of the Project (and continuing for as long as specified herein), Design/Builder shall carry insurance as prescribed herein. All insurance policies shall be with a company or companies lawfully authorized to do business in Florida, and with an A.M. Best rating of no less than A/XV. All insurance policies shall be issued and countersigned by duly authorized representatives of such companies and shall be written on ISO standard forms or their equivalents.
Design Phase. As part of the Design Phase services, the CM/GC shall do the following:
Design Phase. The design phase of the project shall consist of the preparation of completely approved construction documents that reflect the approved Preliminary Engineering Report. It also includes coordination with other design consultants on adjacent segments, and potentially restriping the pavement between Segment 1 and Segment 2. The design consultants of both segments will evaluate and coordinate how to best handle the transition and/or striping. The Design shall build upon the framework identified in the Preliminary Engineering Report and include roadway design, profiles, drainage system and appurtenances, details and the bid documents necessary for a complete design review. The submittal shall be considered final and ready for construction, barring minor comments from Fort Bend County. The Design Submittal shall address all comments from the Preliminary Engineering Phase of the project. The Design Submittal shall include the submittal of the construction ready plans on 11”x17”, the project manual, final utility conflict table, and a final cost estimate in accordance with FBCED requirements. The design submittal includes the following milestones:  70% Submittal (1st Submittal): The submittal shall consist of: o Address 30% Comments o Coversheet o Index of Sheets o Existing and Proposed Typical Sections o Project Layout Sheet o Survey Control Map o Right of Way Map o Horizontal Alignment Data o Plan and Profile o Drainage Area Map o Hydraulic Calculations o Detention Plan o Traffic Control Plan o Traffic Signals & Details (if needed) o Storm Water Pollution Prevention Plan o Cross Sections o Standard Details o Specifications Table of Contents o Spreadsheet based Bid Form with Estimated Unit and Total Costs o 70% Plans on 11”x17” Sheets with Electronic PDF files, and KMZ file of existing conditions and current design o Submit drawings for regulatory permit and utility reviews o 70% Review Checklist  95% Submittal (2nd Submittal): The submittal shall consist of all the 70% requirements plus the following: o Address 70% Comments & Comment Resolution Spreadsheet o Bid Ready (Not Sealed) o General Notes o Signage and Pavement Marking Plans o Project Manual with Bid Form, Specification Table of Contents, Special Specifications or Conditions, and Contract Documents Excluded o 95% Plans on 11”x17” Sheets with Electronic PDF files, and KMZ file of existing conditions and current design o 95% Review Checklist
Design Phase. A.2.1 All documents including drawings and specifications, any changes, revisions or amplifications thereof, as well as all construction cost estimates, shall be subject to the written approval of the Owner before the documents are accepted. The approval of drawings by the Owner is not to be construed as authority to violate, cancel or set aside any provisions of applicable codes. A.2.2 Construction documents must comply with the latest adopted edition of the Uniform Construction Code in effect at the time of approval by the Owner at the FINAL REVIEW phase as defined in the scope of work. A.2.3 Unless otherwise provided in the AGREEMENT documents, the Consultant will be requested to secure and be reimbursed for payment of all permits and governmental fees, licenses and inspections necessary for the proper execution and completion of the work and which are legally required at the time of receipt of bids. A.2.4 In the event that the construction bids received are in excess of 5% of the approved Consultant’s final estimate for construction of the project, and changes to drawings and/or specifications are required to meet such approved estimate, the Consultant shall redesign and/or set up sufficient approved alternate designs, plans and specifications for the project work, to secure a bid that will come within the allocation specified by the Owner without impacting the programmatic requirements of the project. Such redesign work and changes to plans, including reproduction costs for submission in order to obtain final approval and permits, shall be undertaken by the Consultant at no additional cost to the Owner.
Design Phase. Upon execution of this Agreement, the Owner authorizes the Design/Builder to perform the portions of the Work described, and the services reasonably necessary to produce the Deliverables required, in this § 2.2; provided, however, that Design/Builder shall not commence any Work under this Agreement unless the Agreement has been fully executed by the parties, Design/Builder has delivered to Owner all documents required under this Agreement, including, but not limited to, insurance certificates, bonds, and all SDS sheets applicable to the Work being performed hereto. The Design/Builder shall not proceed with other portions of the Work without specific, written authorization from the Owner, and the Owner shall have no obligation to compensate the Design/Builder for Work undertaken but not authorized.
Design Phase. See “Exhibit A – Scope of Services for DP” for scope for the following subphases of the Design Phase: Program Development, Conceptual Design, Schematic Design, Design Development, GMP-Setting and Construction Documents.
Design Phase. For all Design Phase Services, including, but not limited to, providing value engineering services, reviewing Construction Documents for constructability, assisting and meeting with Design Professional during the various design phases, preparing cost estimates and obtaining various project permits, Construction Manager shall receive the fixed amount of $1,198,299.00 as the total lump sum compensation for its services. Said lump sum amount shall be paid in accordance with the following schedule: Lump sum amount at conclusion of design phase.
Design Phase. The Owner shall review and approve design documentation based on the requirements in this Specification, the Contract and the Bridging Documents. The design drawings and associated documents shall represent 100% of the intended and agreed upon scope for the Project. The Contractor shall be solely responsible for providing complete design and engineering, compliant with all applicable laws and the requirements of the Contract and Bridging Documents, by and through appropriately licensed design professionals, including, without limitation, licensed architects and registered professional engineers employed by, or under direct contract with Contractor. The design professionals so engaged shall serve as the Engineer(s) of Record and Architect of Record (for projects requiring an AOR).
