Bid and Contract Documents. Architect shall assist DISTRICT in the completion of all bid and construction documents, including but not limited to, the Notice Inviting Bids, Instructions to Bidders, Contract Bid Forms (including Alternate Bids as requested by DISTRICT), Contract, General Conditions, Supplementary General Conditions, Special Conditions, other necessary conditions of the contract, Project Manual (e.g. conditions of the contract, specifications, and bidding requirements and sample forms), DVBE and other applicable affirmative action documents, Performance Bond, Payment Bond, Escrow Agreement for Security Deposits, and any other certifications and documents required by federal, state and local laws, rules and regulations which may be reasonably required in order to obtain bids responsive to the specifications and drawings. All such documents shall be subject to the approval of DISTRICT and DISTRICT's legal counsel.

All such documents shall be subject to the approval of WestEd and WestEd’s legal counsel.
Bid and Contract Documents. This task provides for the preparation of bid and contract documents including base bid for the equipment. This will incorporate the technical specifications for the equipment with input provided by the County into the bid package. While oral solicitations may be accepted for small purchase procurements, the bid documents will note the preference for written proposals. This task assumed that the County will provide information on the current ARFF Vehicle fleet and County Procurement Information. This also assumes that the County is responsible for the final assembly of the procurement package based on the technical specifications provided by the Consultant. The Consultant will contact potential suppliers and research typical payment schedules for this type of equipment. The Consultant will attend the bid opening and review bids for conformance to specifications. If verbal bids are received, the Consultant will assist in documenting the bid appropriately. The Consultant will prepare a bid recommendation letter. This task will follow the FAA procedures for Small Purchase Procurement [2 CFR § 200.320(b)] and will include a review of FAA PGL19-01: Aqueous Film Forming Foam (AFFF) Input-Based Testing Equipment to confirm project maintains AIP eligibility.
Bid and Contract Documents. CITY shall (1) name the DISTRICT as an express third party beneficiary in all of the construction contracts relating to the XXXXXX III BASIN IMPROVEMENTS, (2) require the contractor(s) to provide Performance and Payment Bonds for each phase of the XXXXXX III BASIN IMPROVEMENTS in an amount no less than 100% of the amount of that particular phase of the XXXXXX III BASIN IMPROVEMENTS which bonds shall name the DISTRICT as an obligee, and (3) include the DISTRICT and County of San Bernardino as an additional insured on all insurance provided by the contractor(s) for the XXXXXX III BASIN IMPROVEMENTS, as set forth in Section 3.4.2.1 below. The Performance Bond obtained for the XXXXXX III BASIN IMPROVEMENTS shall be in a form approved by the DISTRICT if the CITY does not utilize the DISTRICT’s standard Performance Bond form.

  • Project Contracts Prior to the delivery of this Lease, the Company may have entered into a contract or contracts with respect to the acquisition and/or construction of the Improvements. Those contracts, and any such contracts entered into by the Company after delivery of this Lease are hereinafter referred to as the “Project Contracts.” Prior to the delivery hereof, certain work has been or may have been performed on the Improvements pursuant to said Project Contracts or otherwise. Subject to the Lender’s rights in the Project Contracts, the Company hereby conveys, transfers and assigns to the Issuer all of the Company’s rights in, but not its obligations under the Project Contracts and the Issuer hereby designates the Company as Issuer’s agent for the purpose of executing and performing the Project Contracts. After the execution hereof, the Company shall cause the Project Contracts to be fully performed by the contractor(s), subcontractor(s) and supplier(s) thereunder in accordance with the terms thereof, and the Company covenants to cause the Improvements to be acquired, constructed and/or completed in accordance with the Project Contracts. Any and all amounts received by the Issuer, the Trustee or the Company from any of the contractors or other suppliers by way of breach of contract, refunds or adjustments shall become a part of and be deposited in the Project Fund.

  • CONTRACT DOCUMENTS AND CONFLICT OF TERMS This Centralized Contract is composed of the documents set forth below. In the case of any conflict among these documents, conflicts shall be resolved in the order of precedence indicated below.

  • Contractor’s Documents Any licensing and maintenance agreement, or any order-specific agreement or document, including any pre-installation, linked or “click through” agreement that is allowed by, referenced within or incorporated within the Contract whenever the Contract is used for a State procurement, whether directly by the Contractor or through a Contractor’s agent, subcontractor or reseller, is agreed to only to the extent the terms within any such agreement or document do not conflict with the Contract or applicable Minnesota or Federal law, and only to the extent that the terms do not modify, diminish or derogate the terms of the Contract or create an additional financial obligation to the State. Any such agreement or document must not be construed to deprive the State of its sovereign immunity, or of any legal requirements, prohibitions, protections, exclusions or limitations of liability applicable to this Contract or afforded to the State by Minnesota law. A State employee’s decision to choose “accept” or an equivalent option associated with a “click- through” agreement does not constitute the State’s concurrence or acceptance of terms, if such terms are in conflict with this section.
