DESIGN PROFESSIONAL shall prepare any required addenda to the Construction Documents, submit addenda for Building Permit approval through CONSTRUCTION MANAGER @ RISKCONTRACTOR, and distribute all required copies to all necessary parties as determined by the OWNER. DESIGN PROFESSIONAL shall respond only to questions or requests for clarifications concerning the Construction Documents submitted in writing by OWNER or CONSTRUCTION MANAGER @ RISKCONTRACTOR within five (5) business days of receipt of such questions or requests. Bidding Phase. 7.1The Design Professional shall assist the Owner in obtaining bids and in awarding and preparing contracts for construction. DESIGN PROFESSIONAL All costs related to legal notice and initial advertising of project to bid shall be the responsibility of the Owner. An Invitation to Bid shall be prepared by the Design Professional as directed by Owner, and shall include the bid date, location and time. The Central Purchasing Office will advertise for this Project in conformance with the Procurement Code. No solicitation or advertisement to bid may occur prior to attainment of PSFA Approval of School Construction for the Project. The Design Professional shall assist the Owner with local advertisement and shall concurrently load digitally and read-only, in accordance with Paragraphs 9.1 and 11.23, project description to the PSFA public bid advertisement website and construction documents into the PSFA Construction Information and Management System (CIMS). PSFA will train and assist Design Professional as appropriate to fulfill the requirements of this Paragraph. The Design Professional shall provide sets of Construction Documents as required by the OWNER’S Program Manager with six hard copies Owner, sets as required by the reviewing agencies, and one electronic copy sets as appropriate and authorized by the Owner to Bidders, such as General Contractors, major subcontractors, major suppliers or other interested parties approved by the Owner. The Design Professional shall provide an additional number of documents to be placed in plan rooms as well as in the Design Professional's office for review by prospective Bidders. The Design Professional shall charge a refundable plan deposit determined as sufficient by the Owner for each bid set except for those provided to plan rooms, reviewing agencies or others as Owner determines and shall keep an accounting of the deposits. Plan deposits shall be returned only to those returning Construction Documents in good condition. The Design Professional shall clarify and answer any questions about the Construction Documents during the bidding process and shall issue Addenda as required, and as authorized by the Owner, to all other bidding documents prepared by or for DESIGN PROFESSIONAL. Dependent upon the Project schedule, the Bidding Phase may take place Bidders no later than four (4) days prior to or concurrently with code review the date of the Construction Documents. Bidding Phase. 7.1After the Designer has distributed the bid documents meeting all legal requirements the Designer shall:
17.5.1 Receive all inquiries relating to the bid documents and, when necessary, answer questions by preparing and issuing written addenda. DESIGN PROFESSIONAL The Department shall provide review and approve all such addenda prior to issuance to bidders.
17.5.2 When sub-bids are required:
17.5.2.1 Sub-bid openings are conducted electronically through e-bidding vendors.

17.5.4 The Department reviews the general bids for completeness and accuracy.
17.5.5 The Department and the Authority review alternates and their acceptance. Recommendations may be requested by the Department and the Authority.
17.5.6 Check references of the Construction Documents lowest eligible and all other bidding documents prepared by or for DESIGN PROFESSIONALresponsible general bidders and make written recommendations as to their skill and ability to perform the specified work. Dependent upon If that bidder is rejected, check references of the next eligible bidder.
17.5.7 If the Project schedulehas to be re-bid because of a defect in the bid documents or procedures, the Bidding Phase may Designer shall correct the defect and take place prior the necessary actions for re-bidding the Project on proper bid documents without any additional compensation to or concurrently with code review the Designer.
17.5.8 If the bid of the Construction Documents. Accordingly, DESIGN PROFESSIONAL may be required, as directed by OWNER, to provide CONSTRUCTION MANAGER @ RISK with design documents lowest eligible and other bidding documents prior to one-hundred percent (100%) final approved Construction Documents.
7.2. DESIGN PROFESSIONAL shall assist OWNER in reviewing, evaluating and advising OWNER regarding subcontractor bids and CONSTRUCTION MANAGER @ RISK’S final Project schedule and Guaranteed Maximum Price proposal. DESIGN PROFESSIONAL shall attend the pre-bid conferences and shall be responsible for developing and providing to OWNER any addenda to the Contract Documents that result from those conferences. Written questions by bidders and subcontractors during bidding All revisions made to the Project under this subparagraph shall be answered by subject to the DESIGN PROFESSIONAL through approval of the issuance Authority and the Department. If the Project is revised and re-bid pursuant to this paragraph, the Designer shall not be entitled to additional compensation for its costs in making revisions or taking the necessary actions for re-bidding the Project.
17.5.9 If, due to no fault of the Designer, the advertisement for bids does not appear in the Central Register within 90 calendar days after the approval of the bid documents, the Department shall adjust the Construction Budget to reflect any changes in construction costs due to such bidding delay. Such action shall not affect the Fee for Basic Services.
17.5.10 If the Authority awards a construction contract for an Addendum through amount that exceeds the CONSTRUCTION MANAGER @ RISKestablished Project Construction Budget set out on page one, such an award will not affect the Fee for Basic Services.
