BOCC’s Discretion. Nothing in this Section XIV. B. shall prevent the BOCC from requiring removal of the hangar and other improvements upon expiration of the fully extended 40-year term of this Private Hangar Agreement. The BOCC is not obligated to allow use of the Lease Premises for private operations, nor is the BOCC required to enter into negotiations for a new private operations land lease and operating agreement.

BOCC’s Discretion. Consistent with the BOCC’s ownership of the fee interest in the Leased Premises and notwithstanding the provisions of Sections XIV. A. through C., above, the BOCC, upon expiration of the fully extended 40-year term of this Private Hangar Agreement, may require removal of the Hangar and associated improvements and re-grading and reclamation of the Leased Premises by Xxxxxx. The BOCC shall have full discretion to determine the needed use of the Leased Premises at the time of expiration of the full forty-year extended term of this Private Hangar Agreement; however, the BOCC’s decision shall be guided by the Airport Master Plan then in effect and then-current Airport land use needs.

  • BANK’S DISCRETION Notwithstanding and without prejudice to any other terms and conditions herein, the Bank shall be entitled at any time, in its reasonable discretion and with reasonable notice, to amend, vary, withdraw, restrict, suspend or terminate all or any of the facilities in respect of or in relation to the TBS Access Code and/or the TBS. The committee will accept and review application for a TLS position and will make recommendations to the hiring administrator. In developing recommendations, the committee will utilize measures of teacher effectiveness and professional growth, consider the needs of the school district and review the performance and professional development of the applicants. Teachers who are selected must meet all of the qualification contained in the TLS grant and contained in the law.
