BANK’S DISCRETION. Notwithstanding and without prejudice to any other terms and conditions herein, the Bank shall be entitled at any time, in its reasonable discretion and with reasonable notice, to amend, vary, withdraw, restrict, suspend or terminate all or any of the facilities in respect of or in relation to the TBS Access Code and/or the TBS. The Bank may, from time to time, in its reasonable discretion, make available through the operation of TBS, such other services and/or facilities as the Bank may deem fit.
BANK’S DISCRETION. Notwithstanding and without prejudice to any other terms and conditions herein, we shall be entitled at any time, in our reasonable discretion and without notice and without giving any reason, to amend, vary, withdraw, restrict, suspend or terminate all or any of the facilities and services in respect of or in relation to the TBS Access Code and/or the TBS. We may, from time to time, in our reasonable discretion and without notice, make available through the operation of TBS, such other services and/or facilities as we may deem fit.
BANK’S DISCRETION. Whenever in this Agreement there is a provision that the Bank may act in a particular way, or that the Bank has the discretion to act, the Bank may act in its sole and unilateral discretion, and the Bank’s decision shall not be subject to challenge.
BANK’S DISCRETION. 10.1 The Bank is entitled, at any time in its absolute discretion by giving reasonable prior notice to the Cardmember to refuse or to approve any proposed Card Transaction notwithstanding that the Current Balance available in the Cardmember’s Account allows for any such proposed Card Transaction upon the occurrence of any of the followings:
(a) If the Cardmember breaches or threatens to breach any of the terms and conditions of this Agreement; or
(b) If the Bank believes that the transaction occurred is highly suspicious or suspected to be a fraudulent transaction.
BANK’S DISCRETION. 7.1 The Bank is entitled, at any time in its absolute discretion and without giving prior notice or reason, to refuse to approve any proposed Card Transaction or ATM Card Transaction notwithstanding that the Card Limit(s) would not be exceeded.
7.2 The Bank is entitled, in its absolute discretion without prior notice and without giving any reason, to:
(a) suspend the Cardmember’s right to use the Card entirely or in respect of specific facilities or transactions; and/or
(b) refuse to re-issue, renew or replace the Card, without, in any case, affecting the obligations of the Cardmember under this Agreement which will continue in force and there will be no refund of any annual fees or other fees paid if the right to use the Card is so suspended by the Bank or if the Card is not so renewed or replaced.
7.3 Without prejudice to other provisions of this Agreement, the Bank reserves the right, at any time, in its absolute discretion and without prior notice and without giving any reason, to introduce, amend, vary, restrict or withdraw all or any of the benefits, services, facilities and privileges in respect of or in connection with the use of the Card and/or this Agreement.
BANK’S DISCRETION. 9.1 The Bank is entitled at any time at its absolute discretion to refuse approval of any proposed Transaction notwithstanding that the current balance available in the Account allows for any such proposed Transactions.
9.2 The Bank is entitled at its absolute discretion to (a) suspend the Cardmember’s right to use the Card entirely or in respect of specified privileges; (b) refuse to re-issue, renew or replace the Card, without in any case affecting the obligations of the Cardmember under these Terms and Conditions which will continue in force and there will be no refund of any annual fee or other fees paid or any part thereof if the right to use the Card is so suspended by the Bank or if the Card is not so renewed or replaced; (c) introduce, amend, vary, restrict or withdraw all or any of the benefits, services, facilities and privileges in respect of or in connection with the use of the Card and/or as provided under these Terms and Conditions.
BANK’S DISCRETION. Notwithstanding anything to the contrary contained herein, Bank is not obligated to finance any Eligible Accounts. Bank and Borrower hereby acknowledge and agree that Bank’s agreement to finance Eligible Accounts hereunder is discretionary in each instance. Accordingly, there shall not be any recourse to Bank, nor liability of Bank, on account of any delay in Bank’s making of, and/or any decline by Bank to make, any loan or advance requested hereunder. In addition, this Agreement may be terminated by Borrower or Bank at any time.
BANK’S DISCRETION. Notwithstanding and without prejudice to the other provisions of this Agreement, we are entitled at any time in our discretion without giving you any notice or reason, to:
(a) suspend your right to use the Card entirely or in respect of the Card Transactions; and/or
(b) introduce, amend, vary, restrict, suspend, terminate or withdraw all or any of the benefits, services, facilities and privileges in respect of or in connection with your Card and/or the use of your Card.
BANK’S DISCRETION. 7.1. The Bank is entitled, at any time in its absolute discretion and without giving prior notice or reason, to refuse to approve any such proposed Card Transaction notwithstanding that the Credit Limit would not be exceeded, if the amount of such Card Transaction was debited thereto.
7.2. The Bank is entitled, in its absolute discretion, without prior notice and without giving any reason, to:
(a) Suspend the Cardmember’s right to use the Card entirely or in respect of specific facilities whereupon all debit balance to the Card will be due and payable immediately on such payment due date as may be stipulated by the Bank; and/or
(b) Refuse to re-issue, renew or replace the Card, without, in any case, affecting the obligations of the Cardmember under this Agreement which will continue in force, and there will be no refund of any annual fees or other fees paid if the right to use the Card is so suspended by the Bank or if the Card is not renewed or replaced.
7.3. Without prejudice to other provisions in this Agreement, the Bank reserves the right, at any time, in its absolute discretion and without prior notice and without giving any reason, to introduce, amend, vary, restrict or withdraw all or any of the benefit, services, facilities and privileges in respect of or in connection with the use of the Card and/or this Agreement.
7.4. The Bank is entitled to pay the credit balance (if any) on the Card Account to the Cardmember (or to the Cardmember’s executer(s) or administrator(s) in the event of the Cardmember’s death) and shall not be obligated to enquire about the beneficial rights to such funds. In addition, any benefits such as reward points will terminate Cardmember’s upon death.
BANK’S DISCRETION. Bank’s obligation to fund any draw on the Line of Credit Loan and to fund any Loan made pursuant to the Closed End Line is subject to the receipt and the approval by Bank of documentation concerning Borrower, Guarantors, and the Practice, in form and substance acceptable to Bank and Bank’s counsel in their sole discretion.
