Common use of CALIFORNIA INTEGRATED WASTE MANAGEMENT ACT INDEMNIFICATION Clause in Contracts

CALIFORNIA INTEGRATED WASTE MANAGEMENT ACT INDEMNIFICATION. Contractor agrees to indemnify and hold harmless the Indemnitees against all fines and/or penalties imposed by CalRecycle or the Local Enforcement County (LEA) based on Contractor’s failure to comply with laws, regulations or permits issued or enforced by CalRecycle or the LEA or caused or contributed to by Contractor’s failure to perform obligations under this Agreement. This indemnity obligation is subject to the limitations and conditions in Public Resource Code Section 40059.1 but is enforceable to the maximum extent allowable by that Section. This indemnity shall survive the termination or earlier expiration of this Agreement.

This indemnity obligation is subject to the limitations and conditions in Public Resource Code Section 40059.1 as may be amended or renumbered from time to time, but is enforceable to the maximum extent allowable allowed by that Section. This indemnity shall survive the termination or earlier expiration of this Agreement.
