Health and Safety Representatives. 12.1 The Employer and its Employees will comply with Part 5 of the WHS Act – Consultation, representation and participation in relation to the establishment of a health and safety committee. To ensure a timely resolution of issues in relation to WHS, all parties may be represented on the health and safety committee. 12.2 A standing invitation will exist for the Union to assist in the voting up of Health and Safety Representatives and the forming of safety committees. Health and safety representative/s (HSR) shall be elected by the Employees on the job, via a show of hands vote conducted by a representative of the Union and shall be subject to recall by a similar process. 12.3 Parties covered by this Agreement recognise the important role of HSRs. The HSRs have a key role in the early intervention in health and safety issues under this Agreement. 12.4 The HSRs shall be allowed to consult with the PCBUs, Unions, principal contractor or persons acting on his/her behalf, on matters directly concerned with the safety of workers, and promote the safe conduct of work generally.
Health and Safety Representatives. 58.1 The Employer and its Employees will comply with Part 7 of the OHS Act – Representation of Employees in relation to the establishment of designated work groups and the election of Health and Safety Representatives. 58.2 The Health and Safety Representative/s shall be elected by the Employees on the job on a democratic basis, and shall be subject to recall by a similar process. 58.3 Parties covered by this Agreement recognise the important role of Health and Safety Representatives. The Health and Safety Representatives have a key role in the early intervention in health and safety issues under this Agreement. 58.4 The Health and Safety Representative/s shall be allowed to consult with the principal contractor, or persons acting on his/her behalf, on matters directly concerned with safety of workers, and promote the safe conduct of work generally. 58.5 The Parties acknowledge that the Health and Safety Representative has a right under section 58 of the OHS Act.

The HSRs have a key role in the early intervention in health and safety issues under this Agreement. 33.5 The HSR shall be allowed to consult with any party reasonably required to act on matters directly concerning the safety of workers and promote the safe conduct of work generally. 33.6 A health and safety representative will be allowed reasonable paid time during working hours to attend to occupational health and safety matters affecting Employees he/she represents providing that the Representative informs their manager they are leaving their work area, where they are going and an estimate of how long they expect to be.

(vi) HSRs will have the right to convene and address a meeting of employees following site induction to facilitate consultation relating to site matters, work health and safety and compliance. (vii) At all times the HSR may seek the assistance of the Union, or a person suitability qualified in WHS. A supervisor may also seek such advice or assistance.
Health and Safety Representatives. School based employees who are elected trade union Health and Safety Representatives are also entitled to reasonable paid time off during working hours to carry out their statutory functions and undertake recognised training.
