Carer’s Leave. i. Use of Sick Leave: An employee, other than a casual employee, with responsibilities in relation to a class of person set out in subclause (iv)(b) below who needs the employee's care and support shall be entitled to use, in accordance with this subclause, any current or accrued sick leave entitlement, provided for at Clause 25 Part A, Sick Leave of this Agreement, for absences to provide care and support for such persons when they are ill. Such leave may be taken for part of a single day. ii. The employee shall, if required, establish either by production of a medical certificate or statutory declaration, the illness of the person concerned and that the illness is such as to require care by another person. In normal circumstances, an employee must not take carer's leave under this subclause where another person has taken leave to care for the same person. iii. ▇▇▇▇▇’s leave is not intended to be used for long term, ongoing care. In such cases, the employee is obligated to investigate appropriate care arrangements where these are reasonably available. iv. The entitlement to use sick leave in accordance with this subclause is subject to:- a) The employee being responsible for the care of the person concerned; and b) The person concerned being; c) A spouse of the employee; or • A defacto spouse, who, in relation to a person, is a person of the opposite sex to the first mentioned person who lives with the first mentioned person as the husband or wife of that person on a bona fide domestic basis although not legally married to that person, or • A child or an adult child (including an adopted child, a step child, ▇▇▇▇▇▇ child or an ex nuptial child), parent (including a ▇▇▇▇▇▇ parent, step parent and legal guardian), parents of spouse, grandparent, grandchild or sibling (including half, ▇▇▇▇▇▇ and step sibling) of the employee or spouse or de facto spouse of the employee; or • A same sex partner who lives with the employee as the de facto partner of that employee on a bona fide domestic basis; or • A relative of the employee who is a member of the same household, where for the purposes of this paragraph:- a) Relative' means a person related by blood, marriage or affinity; b) Affinity' means a relationship that one spouse because of marriage has to blood relatives of the other; and c) Household' means a family group living in the same domestic dwelling. v. An employee shall, wherever practicable, give the council notice prior to the absence of the intention to take leave, the name of the person requiring care and that person's relationship to the employee, the reasons for taking such leave and the estimated length of absence. If it is not practicable for the employee to give prior notice of absence, the employee shall notify the employer by telephone of such absence at the first opportunity on the day of absence. vi. Time off in Lieu of Payment for Overtime: An employee may, with the consent of the council, elect to take time in lieu of payment of overtime accumulated in accordance with the provisions of Clause 23 Part A of this Agreement for the purpose of providing care and support for a person in accordance with subclause (iv) above. vii. Make-up time: An employee may elect, with the consent of the council, to work 'makeup time', under which the employee takes time off during ordinary hours, and works those hours at a later time, within the spread of ordinary hours provided in the Agreement, at the ordinary rate of pay for the purpose of providing care and support for a person in accordance with subclause (iv) above.

Carer’s Leave. i. In usual circumstances an employee is not entitled to take carer’s leave where another person concerned being; c) A spouse is available to care of the employee; person concerned. 28.2.4 The term “immediate family” includes spouse or partner, parent (including ▇▇▇▇▇▇ parent), parents of spouse or partner, grandparent or grandchild, sibling of employee or spouse / partner (including half, ▇▇▇▇▇▇ and step sibling) child, ▇▇▇▇▇▇▇▇▇, ▇▇▇▇▇▇ child and a relative of the employee who is a member of the same household. 28.2.5 A defacto spouse, who, in relation to a person, is a person of the opposite sex to the first mentioned person who lives with the first mentioned person as the husband or wife of that person on a bona fide domestic basis although not legally married to that person, or • A child or an adult child (including an adopted child, a step child, ▇▇▇▇▇▇ child or an ex nuptial child), parent (including a ▇▇▇▇▇▇ parent, step parent and legal guardian), parents of spouse, grandparent, grandchild or sibling (including half, ▇▇▇▇▇▇ and step sibling) of the employee or spouse or de facto spouse of the employee; or • or 28.2.6 A same sex partner who lives with the employee as the de facto partner of that employee on a bona fide domestic basis; or • A relative of the employee who is a member of the same household, where for the purposes of this paragraph:- a) Relative' means a person related by blood, marriage or affinity; b) Affinity' means a relationship that one spouse because of marriage has to blood relatives of the other; and c) Household' means a family group living in the same domestic dwelling. v. 28.2.7 An employee shall, wherever practicablewhenever practical, give the council MCW notice prior to the absence of the their intention to take carer’s leave, the name of the person requiring care and that person's the relationship to the employee, the reasons for taking such leave and the estimated length of absence. If it is not practicable for the an employee to give prior notice of absence, the employee shall notify the employer MCW by telephone of such absence at the first opportunity on the day of absence. vi. Time off in Lieu 28.2.8 An employee must, if required by MCW, verify by production of Payment for Overtime: a medical certificate or a statutory declaration, the illness of the person concerned, and that the illness is such that it requires care by another person. 28.2.9 An employee may, with the consent of the councilMCW, elect to take use accumulated time in lieu of payment of overtime accumulated in accordance with the provisions of Clause 23 Part A of this Agreement for the purpose of providing care and support for a person in accordance with subclause (iv) above. vii. Make-payment, work “make up time: An employee may elect, with the consent of the council, to work 'makeup time', under which the employee takes time off during ordinary hours, and works those hours at a later time, within the spread of ordinary hours provided in the Agreement, at the ordinary rate of annual leave or leave without pay for the purpose of providing care and support for a person in accordance with subclause (iv) above▇▇▇▇▇’s Leave.

(iii) The employee shall, if required, a) establish either by production of a medical certificate or statutory declaration, the illness of the person concerned and that the illness is such as to require care by another person; or b) establish by production of documentation acceptable to council or a statutory declaration, the nature of the emergency and that such emergency resulted in the person concerned requiring care by the employee. In normal circumstances, an employee must not take carer’s leave under this subclause where another person has taken leave to care for the same person. (vi) An employee shall, wherever practicable, give the council notice prior to the absence of the intention to take leave, the name of the person requiring care and that person's relationship to the employee, the reasons for taking such leave and the estimated length of absence. If it is not practicable for the employee to give prior notice of absence, the employee shall notify the employer by telephone of such absence at the first opportunity on the day of absence. vi. Time off in Lieu of Payment for Overtime: An employee may, with the consent of the council, elect to take time in lieu of payment of overtime accumulated in accordance with the provisions of Clause 23 Part A of this Agreement for the purpose of providing care and support for a person in accordance with subclause (iv) above. vii. Where employees have exhausted all paid personal leave entitlements, they are entitled to use, in accordance with this subclause, any current take unpaid personal leave to care for members of their immediate family or accrued household who are sick leave entitlement, provided for at Clause 25 Part A, Sick Leave of this Agreement, for absences to provide and require care and support for such persons when they or who require care due to an unexpected emergency. The Employer and the employee shall agree on the period. In the absence of agreement, the employee is entitled to take up to two days (up to a maximum of 16 hours) per occasion, provided the requirements of subclauses (4)(c) and (4)(f) of this clause are ill. Such leave may be taken for part of a single daymet. ii. An employee shall, wherever practicable, give the council notice prior to the absence of the intention to take leave, the name of the person requiring care and that person's relationship to the employee, the reasons for taking such leave and the estimated length of absence. If it is not practicable for the employee to give prior notice of absence, the employee shall notify the employer by telephone of such absence at the first opportunity on the day of absence. vi. Time off in Lieu of Payment for Overtime: An employee may, with the consent of the council, elect to take time in lieu of payment of overtime accumulated in accordance with the provisions of Clause 23 Part A of this Agreement for the purpose of providing care and support for a person in accordance with subclause (iv) above. vii. Time off in Lieu of Payment for Overtime: An employee may, with the consent of the council, elect to take time in lieu of payment of overtime accumulated in accordance with the provisions of Clause 23 Part A of this Agreement for the purpose of providing care and support for a person in accordance with subclause (iv) above. vii. Carer’s Leave. i. Use of Sick Leave: Employees shall be entitled to use their current and accrued personal leave as carers leave as follows:- 28.2.1 An employee, other than a casual employee, employee with responsibilities in relation to a class member of person set out in subclause (iv)(b) below their “immediate family” or a relative who is a member of the same household who needs the employee's ’s care and support support, shall be entitled to use, in accordance with this subclause, any current or accrued sick use their personal leave entitlement, provided for at Clause 25 Part A, Sick Leave of this Agreement, for absences to provide for care and support for such persons when they are illill or injured. Such leave may be taken for as part of a single day. ii. The employee shall, if required, establish either by production of a medical certificate or statutory declaration, the illness of the person concerned and that the illness is such as to require care by another person. In normal circumstances, an employee must not take carer's leave under this subclause where another person has taken leave to care for the same person. iii. ▇▇▇▇▇28.2.2 Carer’s leave is not intended to be used for long term, ongoing care. In such cases, cases the employee is obligated to investigate appropriate alternative care arrangements where these are reasonably available. iv. The 28.2.3 This entitlement to use sick leave in accordance with this subclause is subject to:- a) The employee to employees being responsible for the care and support of the person concerned; and b) The . In usual circumstances an employee is not entitled to take carer’s leave where another person concerned being; c) A spouse is available to care of the employee; person concerned. 28.2.4 The term “immediate family” includes spouse or partner, parent (including ▇▇▇▇▇▇ parent), parents of spouse or partner, grandparent or grandchild, sibling of employee or spouse / partner (including half, ▇▇▇▇▇▇ and step sibling) child, ▇▇▇▇▇▇▇▇▇, ▇▇▇▇▇▇ child and a relative of the employee who is a member of the same household. A defacto spouse, who, in relation to a person, is a person of the opposite sex to the first mentioned person who lives with the first mentioned person as the husband or wife of that person on a bona fide domestic basis although not legally married to that person, or • A child or an adult child (including an adopted child, a step child, ▇▇▇▇▇▇ child or an ex nuptial child), parent (including a ▇▇▇▇▇▇ parent, step parent and legal guardian), parents of spouse, grandparent, grandchild or sibling (including half, ▇▇▇▇▇▇ and step sibling) of the employee or spouse or de facto spouse of the employee; or A same sex partner who lives with the employee as the de facto partner of that employee on a bona fide domestic basis; or • A relative of the employee who is a member of the same household, where for the purposes of this paragraph:- a) Relative' means a person related by blood, marriage or affinity; b) Affinity' means a relationship that one spouse because of marriage has to blood relatives of the other; and c) Household' means a family group living in the same domestic dwelling. v. 28.2.5 An employee shall, wherever practicablewhenever practical, give the council MCW notice prior to the absence of the their intention to take carer’s leave, the name of the person requiring care and that person's the relationship to the employee, the reasons for taking such leave and the estimated length of absence. If it is not practicable for the an employee to give prior notice of absence, the employee shall notify the employer MCW by telephone of such absence at the first opportunity on the day of absence. vi. Time off in Lieu 28.2.6 An employee must, if required by MCW, verify by production of Payment for Overtime: a medical certificate or a statutory declaration, the illness of the person concerned, and that the illness is such that it requires care by another person. 28.2.7 An employee may, with the consent of the councilMCW, elect to take use accumulated time in lieu of payment of overtime accumulated in accordance with the provisions of Clause 23 Part A of this Agreement for the purpose of providing care and support for a person in accordance with subclause (iv) above. vii. Make-payment, work “make up time: An employee may elect, with the consent of the council, to work 'makeup time', under which the employee takes time off during ordinary hours, and works those hours at a later time, within the spread of ordinary hours provided in the Agreement, at the ordinary rate of annual leave or leave without pay for the purpose of providing care and support for a person in accordance with subclause (iv) above▇▇▇▇▇’s Leave.
