Common use of Certification of Fitness Clause in Contracts

Certification of Fitness. (a) After an absence due to illness or injury, the Employer is entitled to require documentation from a physician or from Worker's Compensation Board, certifying that the employee is medically able to resume the full duties of the position. (b) Where the Employer requires an employee to submit to a medical examination or medical interview, it shall be at the Employer's expense with the exception of "condition of employment medical".
