City Development Fees. If the Xxxxxx Springs Governing Body, after execution of this agreement, establishes or amends fees and charges associated with development, including but not limited to planning fees, inspection fees, building fees, park fees, permit fees and utility connection fees, the following conditions shall apply:
A. The fees that are in effect on the date of final approval of a Site Plan and/or Final Plat, whichever is last, shall apply to all building permits that are issued within 12 months of the approval date or as specified separately in Section III of this Development Agreement as approved by the Governing Body. After the 12 month period, the current City fees will be in effect for all building permits.
B. For permits that do not require Governing Body approval, fees that are in effect on the date a building permit is issued will remain in effect until expiration of that building permit.
C. Developer agrees to pay one-time BPU and UG connection fees for water and sewer per agreement to allow Xxxxxx Springs to connect to their respective utilities.
City Development Fees. (a) Developer shall pay those processing, building permit, inspection and plan checking fees and charges required by City for processing applications and requests for Subsequent Approvals under the applicable regulations in effect at the time such applications and requests are submitted to City.
(b) Consistent with the terms of the Agreement, City shall have the right to impose only such development fees (“Development Fees”) as had been adopted by City as of the date the Project’s development application was determined to be complete (i.e. February 9, 2023), as set forth in Exhibit C, only at those rates of such Development Fees in effect at the time of payment of the Development Fees. The Development Fees shall be paid at the time set forth in Exhibit C except as otherwise provided in Article 3 of this Agreement. This Section 3.2(b) shall not prohibit City from imposing on Developer any fee or obligation that is imposed by a regional agency or the State of California in accordance with state or federal obligations and required to be implemented by City.
