Common use of City Grievance Clause in Contracts

City Grievance. A City grievance shall be processed in the following manner and within the time limits stated herein: Step 1. The City shall present, in writing, to the Local President its grievance within twenty (20) calendar days, excluding Saturday, Sunday and the City’s fixed holidays, of the date the City became aware of the grievance. Step 2. The Local President shall reply, in writing, to the City within ten (10) calendar days, excluding Saturday, Sunday and the City’s fixed holidays, of the Union’s receipt of the City grievance. Step 3. If the grievance is not settled by the Union’s reply, the City may present its grievance to arbitration, in accordance with Section 5.4. The City shall notify, in writing, the Union of its demand for arbitration within fifteen (15) calendar days, excluding Saturday, Sunday and the City’s fixed holidays, of its receipt of the Union’s reply. A grievance not processed within the time limits set out in this Article is deemed to have been withdrawn.

Step 2. The Local President shall reply, in writing, to the City within ten (10) calendar days, excluding Saturday, Sunday and the City’s fixed holidays, of the Union’s receipt of the City grievance. Step 3. If the grievance is not settled by the Union’s reply, the City may present its grievance to arbitration, in accordance with Section 5.4. The City shall notify, in writing, the Union of its demand for arbitration within fifteen seven (157) calendar days, excluding Saturday, Sunday and the City’s fixed holidays, of its receipt of the Union’s reply. A grievance not processed within the time limits set out in this Article is deemed to have been withdrawn.
