CLASS REMOVALS. Classroom removals may be used for serious offenses or when in-class or alternative restorative and/or progressive discipline have proven ineffective. Teachers will make parent contact the day of any class removals verbally and in writing. A Behavior Plan or Contract may be designed following class removals. When a student is sent to the principal for a "class removal", or for putting themselves, or others in danger, or has caused injury to another student, the consequences will become more severe. The action taken will be based upon the severity of the incident and the students past history. Parental contact will be made.

  • Trustee May Enforce Claims Without Possession of Certificates All rights of action and claims under this Agreement or the Certificates may be prosecuted and enforced by the Trustee without the possession of any of the Certificates or the production thereof in any proceeding relating thereto, and such preceding instituted by the Trustee shall be brought in its own name or in its capacity as Trustee. Any recovery of judgment shall, after provision for the payment of the reasonable compensation, expenses, disbursement and advances of the Trustee, its agents and counsel, be for the ratable benefit of the Certificateholders in respect of which such judgment has been recovered.

  • Servicer May Own Notes or Certificates The Servicer, and any Affiliate of the Servicer, may, in its individual or any other capacity, become the owner or pledgee of Notes or Certificates with the same rights as it would have if it were not the Servicer or an Affiliate thereof, except as otherwise expressly provided herein or in the other Basic Documents. Except as set forth herein or in the other Basic Documents, Notes and Certificates so owned by or pledged to the Servicer or such Affiliate shall have an equal and proportionate benefit under the provisions of this Agreement, without preference, priority or distinction as among all of the Notes and Certificates.
