Codefendant with Board. Where the employee as a result of the employment relationship, is a codefendant with the Board in an action brought by a third party, the employee shall be permitted leave of absence without deduction of salary or sick leave for the purposes of responding to the action with the Board.

Codefendant with Board. (a) Where the employee as a result of the employment relationship, is a codefendant with the Board in an action brought by a third party, the employee shall be permitted leave of absence without deduction of salary or sick leave for the purposes of responding to the action with the Board. (b) This provision only applies to the extent the employee and the Board have common interests and does not apply to any parallel action in which the Board is not a defendant. (c) This provision ceases to apply upon the Board ceasing to be a defendant in such an action.
