Commencement Date Conditions Defined. The obligations of the Company and the Borough to proceed with their respective obligations hereunder regarding Operation Services shall not commence until all of the Company’s Transition Period Responsibilities, set forth in Section 4.1, have been achieved. In addition, the Borough shall have the right to postpone the Commencement Date until all of the following conditions have been achieved, which together with the achievement of all of the Company’s obligations under Section 4.1, shall constitute the “Commencement Date Conditions.”

The obligations of the Company and the County to proceed with their respective obligations hereunder during the Operation Period will not commence until all of the following conditions (the “Commencement Date Conditions”) are satisfied or waived by both Parties:

The obligations of the Company and the WPCA to proceed with their respective obligations hereunder during the Operation Period shall not commence until all of the Company’s Transition Period Responsibilities, set forth in Section 4.1 (Company Transition Period Responsibilities), have been achieved. In addition, the WPCA shall have the right to postpone the Commencement Date, but not further than the Scheduled Commencement Date, until all of the following conditions have been achieved, which together with the achievement of all of the Company’s Transition Period Responsibilities, shall constitute the “Commencement Date Conditions.”
