Common use of Commencement of Employment Clause in Contracts

Commencement of Employment. All prospective Employees shall complete the Company pre-employment application form and undertake a pre-placement medical assessment at the Company’s expense. The pre-placement assessment will involve a general physical examination to assess the potential Employee’s ability to perform the inherent requirements of the role and will include drug and alcohol testing. The Parties agree that new Employees shall be subject to a probationary period of up to 26 weeks. The full- time equivalent period in which an Employee was engaged as a casual immediately prior to appointment as a regular employee will be considered as service (1 week for every 38 ordinary hours as a casual) for the purpose of determining probationary service. At any time during or at the end of the first 13 weeks of probationary employment, an Employee’s manager may review the probationary Employee’s performance/behaviour. If the manager is completely satisfied with the Employee’s performance/behaviour, the probation period will end at that time. If there remain some concerns about the Employee’s performance/behaviour, such concerns may be raised with the Employee and the probation period may be continued up to the maximum 26 week period. During the period of probationary employment, the Company or the Employee may terminate the employment by the giving of one (1) weeks notice (or payment the Company or forfeiture by the Employee of payment in lieu of notice). On commencement, and on a change in employment category, Employees will be advised in writing of the key terms and conditions of their employment. New Employees will be provided a copy of this Agreement.
