Communications and Data Exchange. Each BGS-RSCP Supplier and the Company shall supply to each other all data, materials or other information that is specified in this Agreement, or that may otherwise reasonably be required by BGS-RSCP Suppliers or by the Company in connection with the provision of BGS-RSCP Supply by the BGS-RSCP Supplier to BGS-RSCP Customers, if required, in a thorough and timely manner. Electronic information exchange between each BGS-RSCP Supplier and the Company under this Agreement shall employ a BGS-RSCP Supplier identification number, assigned by the Company, which shall be consistent with the BGS-RSCP Supplier’s Xxxx & Bradstreet Business number. Each BGS-RSCP Supplier must be equipped with the communications capabilities necessary to comply with the communications and data exchange standards that are set by and as may, from time to time, be modified by PJM, and must bear the costs of putting in place and successfully testing all required information technology systems that will enable it to send to and receive data from the Company and PJM and to satisfy its obligations under this Agreement, the PJM Agreements and all other relevant agreements.

Communications and Data Exchange. The DS Supplier and the Company shall supply to each other in a thorough and timely manner all data, materials or other information that is specified in this Agreement, or that may otherwise reasonably be required by DS Supplier or by the Company in connection with the provision of DS Supply by the DS Supplier to DS Customers, if required. The DS Supplier shall be equipped with the communications capabilities necessary to comply with the communications and data exchange standards that are set by and as may, from time to time, be modified by PJM, and shall exclusively bear the costs of installing, maintaining, testing, and operating all required information technology systems that will enable it to send to and receive data from the Company and PJM and to satisfy its obligations under this Agreement, the PJM Agreements and all other relevant agreements.
Communications and Data Exchange. The BGS-FP Supplier and each of the Companies shall supply to each other all data, materials or other information that is specified in this Agreement, or that may otherwise reasonably be required by the BGS-FP Supplier or by one or more of the Companies in connection with the provision of BGS-FP Supply by the BGS-FP Supplier to one or more of the Companies, if required, in a timely manner. The BGS-FP Supplier must be equipped with the communications capabilities necessary to comply with the communications and data exchange standards that are set by and as may, from time to time, be modified by the MISO, and must bear the costs of putting in place and successfully testing all required information technology systems of the BGS-FP Supplier that will enable it to send data to and receive data from each of the Companies and the MISO and to satisfy its obligations under this Agreement, the MISO Agreements and all other relevant agreements.

The Company will provide to Supplier Representatives copies of the standard file formats containing the aforementioned data. Nothing herein shall prohibit the Company from making available to the Suppliers other electronic data, in formats chosen by the Company. The Company will not change the file formats without providing Suppliers with adequate notice of any such change.

For a Supplier to offer Consolidated Billing service under this Agreement, Supplier must have in place and demonstrate to the Company’s reasonable satisfaction, in a volume commensurate with the number of customers reasonably expected to be served, the ability to accept billing information from Company, accurately produce and render the xxxx, process payments from Customers, respond to Customer inquiries, and comply with collection laws and regulations. All costs associated with establishing such communications capabilities required by this section shall be borne by Supplier. Company makes no representations regarding the efficacy of the above-referenced data exchange testing/demonstration process, and shall not be liable to Supplier for any claims that inadequate, improper, or incomplete Company testing processes or testing requirements resulted in subsequent communications or data exchange difficulties.

The Cooperative will provide to Supplier Representatives copies of the standard file formats containing the aforementioned data. Aggregator requests for 12-Month Historical Usage must utilize EDI. The Company’s fulfillment of these requests will utilize standard EDI protocols for providing historical monthly summary usage.
