Common use of Compensation for Tools and Clothing Clause in Contracts

Compensation for Tools and Clothing. An Employee whose clothes, spectacles, hearing aid, or tools have been accidentally spoilt by acid, sulphur or other substances will be paid such amount to cover the loss thereby suffered by the employee as may be agreed upon between the employee and the employer. An Employee will be reimbursed by the Employer to the maximum amount in APPENDIX ONE, SECTION FIVE for loss of tools or clothing by fire or breaking and entering whilst securely stored at the Employer’s direction in a room or building on the Employer’s premises, job or workshop, or if the tools are lost or stolen while being transported by the Employee at the employers’ direction, or if the tools are accidentally lost over water or if tools are lost or stolen during an Employee’s absence after leaving the job because of injury or illness. An Employee transporting their own tools will take all reasonable care to protect those tools and prevent theft or loss. The parties agree that strict adherence on both sides regarding use and provision of storage facilities is to be adhered to. Compensation will not be applied where an Employee has not followed the Employer’s clear instructions. Where an Employee is absent from work because of illness or accident and has advised the Employer, the Employer will ensure that the Employee’s tools are securely stored during their absence. In the event that these tools are lost or stolen, the amount payable for compensation for tools applies. Reimbursements will be at the current replacement value of new tools of the same or comparable quality. The Employee will report any theft to the police prior to making a claim on the Employer for replacement of stolen tools

Where an Employee is absent from work because of illness or accident and has advised the EmployerEmployer in accordance with clause 46 – Personal Leave/ Carer’s Leave, the Employer will ensure that the Employee’s tools are securely stored during their absence. In the event that If these tools are lost or stolen, the amount payable in Appendix 3 for compensation for tools applies. Reimbursements will be at the current replacement value of new tools of the same or comparable quality.
