Common use of Compensation Upon Separation Clause in Contracts

Compensation Upon Separation. Accumulated (unused) sick leave will be reimbursed at termination of the employment up to an accumulation of twelve hundred and eighty (1280) hours as follows: % Credit = 5 + H/32 In the above formula, "H" is the accumulated (unused) sick leave hours at termination of employment. The number of hours of sick leave that will be reimbursed will be the credit times the number of hours of accumulated sick leave, but not to exceed twelve hundred and eighty (1280) hours. Pay = R x H/100 [ 5 + (H/32) ] In the above formula, "R" is the hourly rate of pay of the operator at date of termination, and "H" is the accumulated sick leave hour balance at date of termination, but not to exceed twelve hundred and eighty (1280) hours. The above provisions shall apply only to full-time operators who have completed one (1) full year of service with the City of Xenia. Death, either on duty or off duty, is considered as a separation from service and compensation for accrued but unused sick leaves (as identified in this Section) will be paid according to law.
