Common use of Compensation Upon Separation Clause in Contracts

Compensation Upon Separation. Accumulated (unused) sick leave at termination of employment up to an accumulation of twelve hundred eighty (1,280) hours (one hundred sixty (160) working days) will be reimbursed as follows: In the above formula, "H" is the accumulated (unused) sick leave hours at termination of employment. The number of hours of sick leave that will be reimbursed will be the credit times the number of hours of accumulated sick leave, but not to exceed twelve hundred eighty (1,280) hours. In the above formula, "R" is the hourly rate of pay of the officer at date of termination, and "H" is the accumulated sick leave hour balance at date of termination, but not to exceed twelve hundred eighty (1,280) hours. The above provisions shall apply only to full-time employees who have completed one full year of service with the City of Xenia. Death, either on duty or off duty, is considered as a separation from service, and compensation for accrued but unused sick leave (as identified in this Section) will be paid according to law.
