Upon completion of all activities in the Punch List to the satisfaction of the DOT, DOT shall issue a completion certificate to the Lessee certifying the completion of construction or implementation or development activities as applicable under the Phase in consideration and that all parts of Project Facility for which the Provisional Certificate had been issued - can be legally, safely and reliably opened for commercial operation or use (the “Completion Certificate”) under intimation to DOT. In the event of the Lessee’s failure to complete the items in the Punch List within the said period of 120 (one hundred and twenty) days, DOT may, without prejudice to any other rights or remedy available to it under this Agreement, have such items completed at the risk of and cost to the Lessee. The Lessee shall reimburse to DOT on demand the entire costs incurred by Engineer DOT in charge but not more than 12 months after opening completing the items in the Punch List.
1.35.2 Upon successful completion of inspections for each phase, DOT will forthwith issue to trafficthe Lessee a Provisional Certificate or Completion Certificate for that particular phase, as the case may be.

17.2 17.2) After the work is completed, completed the contractor shall give notice of such completion to the Engineer in Engineer-in-charge and within 30 days of receipt of such a notice the Engineer in Engineer-in-charge shall inspect the work and if there is no defect in the work, shall furnish the contractor with a certificate indicating the date of completion. However, if there are any defects which in the opinion of the engineer in Engineer-in-charge are rectifiable he shall inform the contractor the defects noticed. The contractor after rectification of such defects shall then inform the engineer in Engineer-in- charge and engineer Engineer-in charge on his part shall inspect the work and issue the necessary completion certificate within 30 days if the defects are rectified to his satisfaction, and if not not, he shall inform the contractor indicating defects yet to be rectified. The time cycle as above above, shall continue.
17.3 17.3) In case defects noticed by the Engineer in Engineer-in-charge which in his opinion are not rectifiable but otherwise work is acceptable at reduced payment, work shall be treated as completed. In such cases completion certificate shall be issued by the Engineer in Engineer-in-charge within 30 days indicating the un-rectifiable defects for which specified reduction in payment is being made by him.
17.4 17.4) The issue of completion certificate shall not be linked up with the site clearance on after completion of the work.
17.5 17.5) Should regular, public traffic be allowed on the bridge, road part of construction is put to use at any stage prior to being taken over then the maintenance period shall be deemed to commence from the date of such traffic passing over the bridge, road & shall be upto 30 days after the date of issue of completion certificate by Engineer in charge but not more than 12 months after opening to trafficcertificate, the maintenance period of that part of the work shall be reckoned from the date of actual use of the facility.

Completion Certificate. 17.1 17.1) The work shall not be considered to have been completed in accordance with the terms of the contract until the Engineer in Engineer-in-charge shall have certified in writing to that effect. No approval of material or workmanship or approval of part of that work during the progress of execution shall bind the engineer in Engineer-in-charge or in any way prevent him for from even rejecting the work which is claimed to be completed and to suspend the issue or of his certificate of completion until such alterations alteration and modification or reconstruction have been effected at the cost of the contractor as shall enable him to certify that the work has been completed to his satisfaction.
