Completion of Punch List items. 14.4.1 All items in the Punch List shall be completed by the Concessionaire within 90 (ninety) days of the date of issue of the Provisional Certificate and for any delay thereafter, other than for reasons solely attributable to the Authority or due to Force Majeure, the Authority shall be entitled to recover Damages from the Concessionaire to be calculated and paid for each day of delay until all items are completed, at the lower of (a) 0.1% (zero point one per cent) of the Performance Security, and (b) 0.2% (zero point two per cent) of the cost of completing such items as estimated by the Independent Engineer. Subject to payment of such Damages, the Concessionaire shall be entitled to a further period not exceeding 120 (one hundred and twenty) days for completion of the Punch List items. For the avoidance of doubt, it is agreed that if completion of any item is delayed for reasons solely attributable to the Authority or due to Force Majeure, the completion date thereof shall be determined by the Independent Engineer in accordance with Good Industry Practice, and such completion date shall be deemed to be the date of issue of the Provisional Certificate for the purposes of Damages, if any, payable for such item under this Clause 14.4.1. 14.4.2 Upon completion of all Punch List items, the Independent Engineer shall issue the Completion Certificate. Failure of the Concessionaire to complete all the Punch List items within the time set forth in Clause 14.4.1 for any reason, other than conditions constituting Force Majeure or for reasons solely attributable to the Authority, shall entitle the Authority to terminate this Agreement.

Completion of Punch List items. Once any Punch List hereunder is agreed upon, Contractor will promptly begin the items thereon. Contractor’s Work on such Punch Lists shall be performed in a manner that does not unreasonably interfere with the commercial operation of the Project. Owner will provide Contractor with reasonable access to the Project Site so that Contractor may perform the Work on the Punch Lists.
Completion of Punch List items. All Punch List Items, other than those ------------------------------- reasonably requiring more than thirty (30) days to complete due to long scheduling or ordering time or other reasonable factors, shall be completed within thirty (30) days after the Completion Date, but in no event later than thirty (30) days after the Outside Completion Date. Any Punch List Items reasonably requiring more than thirty (30) days to complete shall be diligently pursued and completed as promptly as practicable, but in no event later than sixty (60) days after the Outside Completion Date.

Failure of the Concessionaire to complete all the Punch List items within the time set forth in Clause 14.4.1 for any reason, other than conditions constituting Force Majeure or for reasons solely attributable to the Participating ULBs, shall entitle the Lead ULB to terminate this Agreement. 14.4.3 If the Concessionaire fails to complete the Punch List items within said period of 90 days, the Lead ULB may, without prejudice to any other rights or remedy available to it under this Agreement, have such items completed at the risk and costs of the Concessionaire. The cost incurred by the Lead ULB in completing the Punch List items, as certified by the Independent Engineer / the Lead ULB, shall be reimbursed by the Concessionaire to the Lead ULB within 7 days from the date of receipt of a claim in respect thereof from the Lead ULB.
Completion of Punch List items. 6.26.3.1 Before expiration of the Punch List Milestone and before the date of Contract Completion, the CM shall complete all items on the A/E’s Punch List. After completing all items on the A/E’s Punch List, the CM shall provide a written request for Final Inspection of the Work to the A/E. .1 If Work on the A/E’s Punch List cannot be timely completed, the CM shall justify in writing to the reasonable satisfaction of the Contracting Authority and A/E, the reasons the items cannot be completed, .2 Within three business days after receipt of the CM’s request for Final Inspection, the A/E shall complete a Final Inspection of the Work for compliance with the Contract Documents. .3 If multiple inspections of items on the A/E’s Punch List are required due to the CM’s failure to properly and timely complete them, the CM shall pay any additional costs incurred by the A/E, Owner, and Contracting Authority resulting from any attendant delay. The Contracting Authority may deduct those additional costs from payments then or thereafter due the CM. If payments then or thereafter due the CM are not sufficient to cover those amounts, the CM shall immediately pay the amount of the insufficiency to the Owner. 6.26.3.2 If the Project is administered using the State’s web-based project management software, the CM shall receive the A/E’s Punch List and submit its request for Final Inspection, using the “Punch List” business process.
Completion of Punch List items. 6.26.3.1 Within 30 days after the date of Substantial Completion and before the date of Contract Completion, the DB shall complete all items on the Contracting Authority’s Punch List. After completing all items on the Contracting Authority’s Punch List, the DB shall provide a written request for Final Inspection of the Work to the Contracting Authority. .1 If Work on the Contracting Authority’s Punch List cannot be timely completed, the DB shall justify in writing to the reasonable satisfaction of the Contracting Authority the reasons the items cannot be completed, and the DB may propose, for the Contracting Authority’s approval, a time when the DB shall complete those items. .2 Within 3 business days after receipt of the DB’s request for Final Inspection, the Contracting Authority shall complete a Final Inspection of the Work for compliance with the Contract Documents. .3 If multiple inspections of items on the Contracting Authority’s Punch List are required due to the DB’s failure to properly and timely complete them, the DB shall pay any additional costs incurred by the Contracting Authority and Owner resulting from any attendant delay and re-inspections. The Contracting Authority may deduct those additional costs from payments then or thereafter due the DB. If payments then or thereafter due the DB are not sufficient to cover those amounts, the DB shall immediately pay the amount of the insufficiency to the Owner. 6.26.3.2 If the Project is administered using the State’s web-based project management software, the DB shall receive the Contracting Authority’s Punch List and submit its request for Final Inspection, using the “Punch List” business process.
Completion of Punch List items. Contractor shall proceed promptly to complete and correct the Punch List Items no later than thirty (30) Days after the Substantial Completion Date. On a weekly basis after the Substantial Completion Date, Contractor shall update the Punch List to include the date(s) that items listed on such Punch List are completed by Contractor and accepted by Owner. Notwithstanding the foregoing, the items listed on such Punch List shall not be considered complete until Owner shall have inspected such Punch List Items and acknowledged, by notation on the updated Punch List, that such item of Work is complete.

In no event shall the completion of all items on a Punch List, including the final Punch List, occur later than thirty (30) days from the Township’s Acceptance of such Punch List, unless such time is extended in writing by the Township.

Failure of the Concessionaire to complete all the Punch List items within the time set forth in Article 14.3.1 for any reason, other than conditions constituting Force Majeure or for reasons solely attributable to the Authority, shall entitle the Authority to terminate this Agreement.
