Completion, Installation and Commissioning. Herdstar shall provide Customer’s duly authorized engineering and construction contractor(s), agents and operational personnel with reasonable and general telephone call assistance not to exceed one total man hour, in an advisory capacity, regarding the Commissioning of the Product on-site at Customer’s facility; provided however, Herdstar shall not be responsible for installing the Product on site at Customer’s Facility. Customer assumes full responsibility for installation and start-up of the Product and for any loss or damage of whatever nature to persons or property, including all local laws and site condition permits. Customer shall pay for all reasonable costs of travel and lodging associated with Herdstar’s assistance.

Customer assumes full responsibility for installation and start-up of the Product and for any loss or damage of whatever nature to persons or property, including all local laws and site condition permits. If Customer requests on-site assistance from HerdStar, Customer shall pay HerdStar its then current rates per person on site, plus all reasonable travel (technician’s hourly rate, plus airfare and maximum IRS allowed mileage for vehicle travel) and lodging and meal expenses, considering typical lodging and meal costs near location of job site.

  • Delivery/Installation Instructions Due to the varying locations and circumstances involved in deliveries and installations, all deliveries and installations will be quoted on a project by project basis. All installation, labor, and or delivery charges must be shown as a separate line item on quotes and invoices. One of the following delivery methods must be specified on every Agency Purchase Order:

  • Installation, Inspection, and Maintenance The Contractor is responsible for installation and maintenance of the BMPs as a part of its Bid. The Design Professional shall obtain the services of a qualified testing laboratory to inspect the BMPs in accordance with the permits, the costs of such inspections to be borne by the Owner. In the event of Abnormal Weather Conditions or force majeure, the Contractor shall be compensated for re-installation of BMPs at established Unit Prices.

  • Installation, Maintenance, Testing and Repair Unless otherwise agreed in writing by the Parties, to the extent required by Applicable Law, Interconnection provided by a Party shall be equal in quality to that provided by such Party to itself, any subsidiary, affiliates or third party. If either Party is unable to fulfill its obligations under this Section 14.2, it shall notify the other Party of its inability to do so and will negotiate alternative intervals in good faith. The Parties agree that to the extent required by Applicable Law, the standards to be used by a Party for isolating and clearing any disconnections and/or other outages or troubles shall be at parity with standards used by such Party with respect to itself, any subsidiary, affiliate or third party.

  • Commissioning Commissioning tests of the Interconnection Customer's installed equipment shall be performed pursuant to applicable codes and standards. If the Interconnection Customer is not proceeding under Section 2.3.2, the Utility must be given at least ten (10) Business Days written notice, or as otherwise mutually agreed to by the Parties, of the tests and may be present to witness the commissioning tests.

  • Commencement and Completion of Work Upon the Effective Date of the Contract, bidder agrees to commence all Preconstruction Activities. Upon issuance of a Proceed Order, bidder agrees to commence physical activities on the Site with adequate forces and equipment and to complete to Material Completion all work in 90 consecutive calendar days beginning the day after the date of the Proceed Order.   • Commencement and Completion The Work shall commence on _______________, 20__ and shall be complete in accordance with this Agreement without delay on ______________, 20__. In the event the Using Agency’s Program specifies additional commissioning services, the Owner shall procure such services as well. The Owner, through its Executive Administrator, may engage an independent Commissioning Authority. It is the intent of this Article that the Commissioning Authority enforce the requirements mentioned herein and certify that the systems and equipment listed all function properly prior to the initiation of each final inspection.

  • Final Completion The full and final completion of all Work in accordance with the Contract Documents.
