Completion Necessary for Payment. A copy of the City of Beaverton (City) Site Development Improvement Agreement to Construct Required Public and Private Improvements dated July 19, 2018, and Public Facilities Permit No. FC2018-0313 dated March 19, 2019 are attached as Exhibit C (collectively, City Agreement). Payment for Allowed Project Costs as defined in Paragraph B.4 will be made in the form of SDC Credits per Paragraph B.5 when Developer: a) completes the Improvements i) according to the terms of the City Agreement as it may be amended by City and Developer and; ii) in substantial accordance with preliminary plans and specifications provided to District for the Development dated January 31, 2019, and Approved Sanitary Sewer Main SS-A dated January 9, 2019.

Completion Necessary for Payment. A copy of the City of Hillsboro (City) Improvement Agreement to Construct Required Public Improvements dated August 27, 2019, is attached as Exhibit C (City Agreement) and a copy of the Clean Water Services Construction Permit Agreement dated September 23, 2019, is attached as Exhibit C2 (CWS Agreement). Payment for Allowed Project Costs as defined in Paragraph B.4 will be made in the form of SDC Credits per Paragraph B.5 and in the form of Direct Payment per Paragraph B.6 when Developer: a) completes the Improvements i) according to the terms of the City Agreement as it may be amended by City and Developer and; ii) according to the terms of the CWS Agreement as it may be amended by CWS and Developer and; iii) in substantial accordance with Plans.

  • Completion Date The Work under this Contract shall be completed by midnight of the date required in the Contract as the Material Completion and Occupancy Date unless extended by approved requests for extension of time.

  • Security for Payment To secure payment of all obligations due hereunder, the Customer hereby grants to Custodian a continuing security interest in and right of setoff against each Account and all Property held therein from time to time in the full amount of such obligations; provided that, if there is more than one Account and the obligations secured pursuant to this Section can be allocated to a specific Account or the Portfolio related to such Account, such security interest and right of setoff will be limited to Property held for that Account only and its related Portfolio. Should the Customer fail to pay promptly any amounts owed hereunder, Custodian shall be entitled to use available Cash in the Account or applicable Account, as the case may be, and to dispose of Securities in the Account or such applicable Account as is necessary. In any such case and without limiting the foregoing, Custodian shall be entitled to take such other action(s) or exercise such other options, powers and rights as Custodian now or hereafter has as a secured creditor under the New York Uniform Commercial Code or any other applicable law.

  • Project Completion Date It is agreed between the Parties that the Project Completion Date is <END DATE, YEAR>. If the Project is not completed by such date then, subject to an amendment agreed to between the Parties, Alberta Innovates may elect to terminate this Investment Agreement. In such event, Alberta Innovates will notify the Applicant of its decision to terminate as soon as reasonably practical and shall advise the Applicant of the effective date of termination. Alberta Innovates will have no liability or obligation to reimburse the Applicant for any Project Costs incurred after the effective date of termination and may require the Applicant to return any portions of the Investment which were spent on Ineligible Expenses. Additionally, any portion of the Investment not used and accounted for in accordance with this Agreement as of the Project Completion Date or earlier termination is repayable by the Applicant to AI at AI’s request.

  • Completion of Repairs Borrower will commence any Repairs as soon as practicable after the date of this Loan Agreement and will diligently proceed with and complete such Repairs on or before the Completion Date. All Repairs and Capital Replacements will be completed in a good and workmanlike manner, with suitable materials, and in accordance with good building practices and all applicable laws, ordinances, rules, regulations, building setback lines and restrictions applicable to the Mortgaged Property. Borrower agrees to cause the replacement of any material or work that is defective, unworkmanlike or that does not comply with the requirements of this Loan Agreement, as determined by Lender.

  • Project Completion The Contractor agrees to schedule a final job walk with the County. If required, the County will prepare a list of incomplete items, the “Punch List”. The Contractor agrees to complete the “Punch List” corrections and schedule a final project completion job walk. The County will sign the “Punch List” as completed when determined, the project is finished. The Contractor agrees to submit the following along with its final payment request:

  • Responsibility for Payment The Company shall not be responsible for the payment of time used by an employee in the investigation and settlement of a grievance.

  • Basis for Payment DFPS is not obligated to pay unauthorized costs or to pay more than Grantee’s allowable and incurred costs consistent with 45 CFR 75, Subpart E.   • Substantial Completion Date Substantial Completion of the Work as defined in Article 6.1.2 of the General Conditions to the Continuing Contract for Construction Management shall be achieved by July 31, 2022.

  • PREREQUISITES FOR PAYMENT The following applicable requirements shall be fulfilled in order to establish an employee's eligibility for sick leave benefits.

  • Final Completion The full and final completion of all Work in accordance with the Contract Documents.
