Common use of Completion of Development Clause in Contracts

Completion of Development. 5.4.1 Upon the completion of the whole development, Council may review this Agreement, in whole or in part, and may: a. Retain the Agreement in its present form; b. Negotiate a new Agreement; or c. Discharge this Agreement. 5.4.2 In the event that development on the Lands has not been completed within twenty five (25) years from the date of registration of this Agreement at the Registry of Deeds or Land Registry Office, as indicated herein, the Agreement shall have no further force or effect and henceforth the development of the Lands shall conform with the provisions of the Land Use By-law. 5.4.3 For the purpose of this section, completion of development shall mean the issuance of a Mobile Home Permit for the 525th mobile home site. 5.4.4 For the purpose of this section, Council may consider granting an extension of the completion of development time period through a resolution under Section 4.1 of this Agreement, if the Municipality receives a written request from the Developer at least sixty (60) calendar days prior to the expiry of the completion of development time period.

(c) Discharge this Agreement. 5.4.2 7.4.2 In the event that development on the Lands has not been completed within twenty five (2520) years from the date of registration of this Agreement at the Registry of Deeds or Land Registry Office, as indicated herein, the Agreement shall have no further force or effect and henceforth the development of the Lands shall conform with the provisions of the Land Use By-law. 5.4.3 7.4.3 For the purpose of this section, completion of development shall mean the issuance of a Mobile Home Construction Permit for the 525th mobile home siteall dwelling units of each Phase. 5.4.4 7.4.4 For the purpose of this section, Council may consider granting an extension of the completion of development time period through a resolution under Section 4.1 6.1 of this Agreement, if the Municipality receives a written request from the Developer at least sixty (60) calendar days prior to the expiry of the completion of development time period. 7.4.5 Provided the requirements of this Agreement have been fulfilled, the Municipality shall consent to the registration of condominiums on the Lands through the Condominium Act, if requested by the Developer.

Completion of Development. 5.4.1 Upon 7.4.1 If the completion Developer fails to receive a development permit for a Salvage Yard after three (3) years from the date of registration of this Agreement at the whole developmentRegistry of Deeds or Land Registration Office, Council may review this Agreement, in whole or in part, and may: a. (a) Retain the Agreement in its present form; b. (b) Negotiate a new Agreement; or c. (c) Discharge this Agreement. 5.4.2 In (d) for those portions of the event that development on the Lands has not been completed within twenty five (25) years from the date of registration of which are completed, discharge this Agreement at and apply appropriate zoning pursuant to the Registry of Deeds or Land Registry Office, as indicated herein, the Agreement shall have no further force or effect applicable Municipal Planning Strategy and henceforth the development of the Lands shall conform with the provisions of the Land Use By-law. 5.4.3 7.4.2 For the purpose of this section, completion of development shall mean the issuance of a Mobile Home Permit Municipal development permit for the 525th mobile home sitea Salvage Yard. 5.4.4 7.4.3 For the purpose of this section, Council may consider granting an extension of the completion of development time period through a resolution under Section 4.1 of this Agreement6.1, if the Municipality receives a written request from the Developer at least sixty (60) calendar days prior to the expiry of the completion of development time period.
