Conduct of Sea trials. All expenses in connection with Sea Trials are for the account of Builder and Builder shall provide at its own expense the necessary crew to comply with conditions of safe navigation. Sea Trials shall be conducted in the manner prescribed in the Specifications, and shall prove fulfillment of the performance requirements for Sea Trials as set forth in the Specifications. The course of Sea Trials shall be determined by Builder.

Conduct of Sea trials. The sea trial shall be carried out in the presence of representative(s) of the BUYER representatives from the Classification Society and/or Regulatory Bodies, and shall be conducted in the manner described in the Specifications, and shall be sufficient in scope and duration to enable all parties to verify and establish that all elements are functioning in accordance with the specifications. The Builder shall provide necessary crew to comply with the conditions of safe navigation. During the trials, the Buyer’s / Classification Society and Regulatory body’s representatives, will be provided with accommodation and victual ling by the Builder. The Builder shall provide the Vessels with the required quantities of fuel, lubricating oils and grease, fresh water and other stores necessary for the trials, as set-forth in the Specifications. The grades of lubricant, etc. shall be as prescribed by the main engine and auxiliary manufacturers and shall be approved by the Buyer. The fuel oil shall be of a quality acceptable to the Buyer. The trials shall be conducted in the manner to comply with the Specifications. During the speed trials, the hull shall be checked for any excessive vibrations which will be defined mutually (by Buyer and Builder) Shop tests and on-board tests for Main Engine, Auxiliary Engine, various machineries and other equipment shall be conducted as provided for in the Specifications. The shop tests / Factory acceptance tests as may be required shall be witnessed by the Classification Society/ Regulatory bodies as applicable and by not more than two representatives of the Buyer. The travel and other formalities associated with such trials are at Builder’s account. After the sea-trials, the working parts of the machinery shall be inspected, in so far as considered necessary, by the Buyer and the Classification Society. If the period between launching and delivery of the Vessel exceeds full six (6) months, then the Vessel shall be dry-docked prior to delivery for underwater hull cleaning and paint touch up as mentioned in the Specifications.

Landlord shall have no obligations to reimburse Tenant for all or any portion of the cost or value of any such modifications, alterations or improvements so surrendered to Landlord. All modifications, alterations or improvements which are installed or constructed on or attached to the Leased Premises by Landlord and/or at Landlord’s expense shall be deemed real property and a part of the Leased Premises and shall be property of Landlord. All lighting, plumbing, electrical, heating, ventilating and air conditioning fixtures, partitioning, window coverings, wall coverings and floor coverings installed by Tenant shall be deemed improvements to the Leased Premises and not trade fixtures of Tenant.
