Considerans. Met het Raisin-platform voor deposito's, stellen Raisin GmbH, gevestigd aan xx Xxxxxxxxxxx Xxxxxx 00/00, 00000 Berlijn ("Raisin"); en Raisin Bank AG, gevestigd te Xxxxxxxx 00-00, 00000 Xxxxxxxxx am Main ("Raisin Bank"), geïnteresseerde klanten ("Klant") in staat om geld te storten in vrij opneembare en termijndeposito's ("Deposito-voorstellen") van verschillende banken ("Deposito-accepterende Bank"). Bij sommige Deposito-voorstellen xxxxx de Klant geen rechtstreekse contractuele relatie met de Deposito- accepterende Bank aan te gaan of xxxxx de Klant bij die bank geen rekening te openen. In plaats daarvan xxxxxx deposito’s in dergelijke Deposito-voorstellen geplaatst door Raisin Bank op eigen naam, maar namens de Klant ("Deposito van gerechtigde"). Als een Klant een Deposito-voorstel selecteert dat wordt aangemerkt als een Deposito van gerechtigde, xxx geven zij Raisin Bank opdracht het deposito op naam van Raisin Bank uit te voeren, maar namens en voor rekening van de Klant op basis van deze Overeenkomst. Tegelijkertijd zal Raisin Bank de identificatiegegevens van de Klant en het bedrag van het deposito delen met de betreffende Deposito-accepterende Bank, op basis van deze Overeenkomst en een overeenkomst tussen Raisin Bank en de Deposito-accepterende Bank ("Deposito- overeenkomst van gerechtigde"). De tegoeden van verschillende Klanten xxxxxx op een rekening van de gerechtigde bij de Deposito-accepterende Bank aangehouden en elke Klant heeft een economisch belang in de rekening van de gerechtigde ter hoogte van het bedrag van zijn betreffende deposito. Penggunaan tanah masyarakat adat Xxxx Xxxx untuk keperluan usaha perkebunan PT. Era Sakti Wiraforestama bukanlah terjadi dengan sendirinya xxx penguasaan semena-mena, melainkan diawali dengan suatu perjanjian kepada xxxxx masyarakat pemilik tanah tersebut.
