Construction Stage Services. Design-Build Entity shall proceed to execute and complete the Construction Stage services only upon issuance by the Owner to the Design- Builder of an NTP and other Documents set forth in Section 5.3.1 of this Agreement with the construction phase of the Work. Design-Build Entity will provide all Construction Stage Services required for the Project. Design-Build Entity's construction stage services will also include each of the responsibilities summarized below.
Construction Stage Services. The Consulting Engineerwill monitor any construction to the extent described in Appendix A. The Consulting Engineercannot ensure the performance of the contractor nor guarantee against any failure by the Contractorto perform his work in accordance with the contract. The provision of construction stage services creates no contractual relationships between the Consulting Engineer and the contractor and the Consulting Engineer has no liability to the contractor in any way arising out of such services.
